1 | AN ACT concerning aging.
| ||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:
| ||||||||||||||||||||||||
4 | Section 5. The Older Adult Services Act is amended by | ||||||||||||||||||||||||
5 | changing Section 35 as follows: | ||||||||||||||||||||||||
6 | (320 ILCS 42/35)
| ||||||||||||||||||||||||
7 | Sec. 35. Older Adult Services Advisory Committee. | ||||||||||||||||||||||||
8 | (a) The Older Adult Services Advisory Committee is created | ||||||||||||||||||||||||
9 | to advise the directors of Aging, Public Aid, and Public Health | ||||||||||||||||||||||||
10 | on all matters related to this Act and the delivery of services | ||||||||||||||||||||||||
11 | to older adults in general.
| ||||||||||||||||||||||||
12 | (b) The Advisory Committee shall be comprised of the | ||||||||||||||||||||||||
13 | following:
| ||||||||||||||||||||||||
14 | (1) The Director of Aging or his or her designee, who | ||||||||||||||||||||||||
15 | shall serve as chair and shall be an ex officio and | ||||||||||||||||||||||||
16 | nonvoting member.
| ||||||||||||||||||||||||
17 | (2) The Director of Public Aid and the Director of | ||||||||||||||||||||||||
18 | Public Health or their designees, who shall serve as | ||||||||||||||||||||||||
19 | vice-chairs and shall be ex officio and nonvoting members.
| ||||||||||||||||||||||||
20 | (3) One representative each of the Governor's Office, | ||||||||||||||||||||||||
21 | the Department of Public Aid, the Department of Public | ||||||||||||||||||||||||
22 | Health, the Department of Veterans' Affairs, the | ||||||||||||||||||||||||
23 | Department of Human Services, the Department of Insurance, | ||||||||||||||||||||||||
24 | the Department of Commerce and Economic Opportunity, the | ||||||||||||||||||||||||
25 | Department on Aging, the Department on Aging's State Long | ||||||||||||||||||||||||
26 | Term Care Ombudsman, the Illinois Housing Finance | ||||||||||||||||||||||||
27 | Authority, and the Illinois Housing Development Authority, | ||||||||||||||||||||||||
28 | each of whom shall be selected by his or her respective | ||||||||||||||||||||||||
29 | director and shall be an ex officio and nonvoting member.
| ||||||||||||||||||||||||
30 | (4) Thirty-two members appointed by the Director of | ||||||||||||||||||||||||
31 | Aging in collaboration with the directors of Public Health | ||||||||||||||||||||||||
32 | and Public Aid, and selected from the recommendations of |

1 | statewide associations and organizations, as follows:
| ||||||
2 | (A) One member representing the Area Agencies on | ||||||
3 | Aging;
| ||||||
4 | (B) Four members representing nursing homes or | ||||||
5 | licensed assisted living establishments;
| ||||||
6 | (C) One member representing home health agencies;
| ||||||
7 | (D) One member representing case management | ||||||
8 | services;
| ||||||
9 | (E) One member representing statewide senior | ||||||
10 | center associations;
| ||||||
11 | (F) One member representing Community Care Program | ||||||
12 | homemaker services;
| ||||||
13 | (G) One member representing Community Care Program | ||||||
14 | adult day services;
| ||||||
15 | (H) One member representing nutrition project | ||||||
16 | directors;
| ||||||
17 | (I) One member representing hospice programs;
| ||||||
18 | (J) One member representing individuals with | ||||||
19 | Alzheimer's disease and related dementias;
| ||||||
20 | (K) Two members representing statewide trade or | ||||||
21 | labor unions;
| ||||||
22 | (L) One advanced practice nurse with experience in | ||||||
23 | gerontological nursing;
| ||||||
24 | (M) One physician specializing in gerontology;
| ||||||
25 | (N) One member representing regional long-term | ||||||
26 | care ombudsmen;
| ||||||
27 | (O) One member representing township officials;
| ||||||
28 | (P) One member representing municipalities;
| ||||||
29 | (Q) One member representing county officials;
| ||||||
30 | (R) One member representing the parish nurse | ||||||
31 | movement;
| ||||||
32 | (S) One member representing pharmacists;
| ||||||
33 | (T) Two members representing statewide | ||||||
34 | organizations engaging in advocacy or legal | ||||||
35 | representation on behalf of the senior population;
| ||||||
36 | (U) Two family caregivers;

| |||||||
1 | (V) Two citizen members over the age of 60;
| ||||||
2 | (W) One citizen with knowledge in the area of | ||||||
3 | gerontology research or health care law;
| ||||||
4 | (X) One representative of health care facilities | ||||||
5 | licensed under the Hospital Licensing Act; and
| ||||||
6 | (Y) One representative of primary care service | ||||||
7 | providers. | ||||||
8 | The Director of Aging, in collaboration with the Directors | ||||||
9 | of Public Health and Public Aid, may appoint additional citizen | ||||||
10 | members to the Older Adult Services Advisory Committee. Each | ||||||
11 | such additional member must be either an individual age 60 or | ||||||
12 | older or an uncompensated caregiver for a family member or | ||||||
13 | friend who is age 60 or older.
| ||||||
14 | (c) Voting members of the Advisory Committee shall serve | ||||||
15 | for a term of 3 years or until a replacement is named. All | ||||||
16 | members shall be appointed no later than January 1, 2005. Of | ||||||
17 | the initial appointees, as determined by lot, 10 members shall | ||||||
18 | serve a term of one year; 10 shall serve for a term of 2 years; | ||||||
19 | and 12 shall serve for a term of 3 years. Any member appointed | ||||||
20 | to fill a vacancy occurring prior to the expiration of the term | ||||||
21 | for which his or her predecessor was appointed shall be | ||||||
22 | appointed for the remainder of that term. The Advisory | ||||||
23 | Committee shall meet at least quarterly and may meet more | ||||||
24 | frequently at the call of the Chair. A simple majority of those | ||||||
25 | appointed shall constitute a quorum. The affirmative vote of a | ||||||
26 | majority of those present and voting shall be necessary for | ||||||
27 | Advisory Committee action. Members of the Advisory Committee | ||||||
28 | shall receive no compensation for their services.

29 | (d) The Advisory Committee shall have an Executive | ||||||
30 | Committee comprised of the Chair, the Vice Chairs, and up to 15 | ||||||
31 | members of the Advisory Committee appointed by the Chair who | ||||||
32 | have demonstrated expertise in developing, implementing, or | ||||||
33 | coordinating the system restructuring initiatives defined in | ||||||
34 | Section 25. The Executive Committee shall have responsibility | ||||||
35 | to oversee and structure the operations of the Advisory | ||||||
36 | Committee and to create and appoint necessary subcommittees and |

2 | (e) The Advisory Committee shall study and make | ||||||
3 | recommendations related to the implementation of this Act, | ||||||
4 | including but not limited to system restructuring initiatives | ||||||
5 | as defined in Section 25 or otherwise related to this Act.

7 | Section 99. Effective date. This Act takes effect upon | ||||||
8 | becoming law.
