| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Electricity Infrastructure Maintenance Fee |

| Law is amended by changing Section 5-4 as follows:
|

| (35 ILCS 645/5-4)

| Sec. 5-4. Right to franchise contract. A municipality shall |
| 8 |
| be entitled
to require a
franchise contract from an electricity |
| 9 |
| deliverer as a condition of allowing the
the electricity |

| deliverer
to use any portion of any public right of way within |
| 11 |
| the municipality for the
placement and
maintenance of |
| 12 |
| facilities for distributing, transmitting, or delivering
|
| 13 |
| electricity. Such franchise
contract shall be established by |
| 14 |
| ordinance and shall be valid when accepted in
writing by the
|
| 15 |
| electricity deliverer.
