Amends the State Finance Act. Provides that each fiscal year, the General Assembly shall appropriate for educational programs an amount that is equal to or exceeds the sum of (i) the total amount appropriated from general funds for educational programs during the fiscal year immediately preceding the fiscal year for which the appropriation is being made and (ii) 51% of total new general funds available for spending from estimated growth in revenues and funds available because of budgeted program growth and decline in the fiscal year for which the appropriation is being made. Effective immediately.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The State Finance Act is amended by adding |
5 |
| Section 4.5 as follows: |

| (30 ILCS 105/4.5 new) |

| Sec. 4.5. Educational appropriations. Beginning with |
8 |
| fiscal year 2006 and in each fiscal year thereafter, the |
9 |
| General Assembly shall appropriate for educational programs an |
10 |
| amount that is equal to or exceeds the sum of (i) the total |
11 |
| amount appropriated from general funds for educational |
12 |
| programs during the fiscal year immediately preceding the |
13 |
| fiscal year for which the appropriation is being made and (ii) |
14 |
| 51% of total new general funds available for spending from |
15 |
| estimated growth in revenues and funds available because of |
16 |
| budgeted program growth and decline in the fiscal year for |
17 |
| which the appropriation is being made.

| Section 99. Effective date. This Act takes effect upon |
19 |
| becoming law.
