SYNOPSIS AS INTRODUCED:
 
30 ILCS 168/20

    Amends the Tobacco Product Manufacturer's Escrow Act. Provides that a holding of unconstitutionality or the repeal of subdivision (2)(B) of the escrow provisions provided under Section 15 of the Act will not affect, impair, or invalidate any other portion of that Section (now, this severability provision only applies to subdivision (2)(B)(ii)). Effective immediately.

1     AN ACT concerning finance.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Tobacco Product Manufacturers' Escrow Act is
5 amended by changing Section 20 as follows:
 
6     (30 ILCS 168/20)
7     Sec. 20. If this amendatory Act of the 93rd General
8 Assembly or any portion of the amendment to subdivision
9 (2)(B)(ii) of subsection (a) of Section 15 made by this
10 amendatory Act of the 93rd General Assembly is held by a court
11 of competent jurisdiction to be unconstitutional, then such
12 subdivision (2)(B)(ii) of subsection (a) of Section 15 shall be
13 deemed to be repealed in its entirety. If subdivision
14 (2)(B)(ii) of subsection (a) of Section 15 shall thereafter be
15 held by a court of competent jurisdiction to be
16 unconstitutional, then this amendatory Act of the 93rd General
17 Assembly shall be deemed repealed and subdivision (2)(B)(ii) of
18 subsection (a) of Section 15 shall be restored as if no such
19 amendments had been made. Neither any holding of
20 unconstitutionality nor the repeal of subdivision (2)(B)
21 (2)(B)(ii) of subsection (a) of Section 15 shall affect,
22 impair, or invalidate any other portion of Section 15 or the
23 application of such Section to any other person or
24 circumstance, and such remaining portions of Section 15 shall
25 at all times continue in full force and effect.

27     Section 99. Effective date. This Act takes effect upon
28 becoming law.
