SYNOPSIS AS INTRODUCED:
 
210 ILCS 55/6.5 new

    Amends the Home Health Agency Licensing Act. Provides that a home health agency shall (i) annually administer a vaccination against influenza to each client, unless the vaccination is medically contraindicated or the client has refused the vaccine, and (ii) provide or arrange for administration of a pneumococcal vaccination to each client who is age 65 or over who has not received this immunization prior to or upon service initiation, unless the client refuses the offer for vaccination or the vaccination is medically contraindicated. Sets forth requirements in connection with the administration of the vaccinations. Effective immediately.

1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Home Health Agency Licensing Act is amended
5 by adding Section 6.5 as follows:
 
6     (210 ILCS 55/6.5 new)
7     Sec. 6.5. Vaccinations.
8     (a) A home health agency shall annually administer a
9 vaccination against influenza to each client, in accordance
10 with the recommendations of the Advisory Committee on
11 Immunization Practices of the Centers for Disease Control and
12 Prevention that are most recent to the time of vaccination,
13 unless the vaccination is medically contraindicated or the
14 client has refused the vaccine. Influenza vaccinations for all
15 clients age 65 or over shall be completed by November 30 of
16 each year or as soon as practicable if vaccine supplies are not
17 available before November 1. Home health clients whose services
18 start after November 30, during the flu season, and until
19 February 1 shall, as medically appropriate, receive an
20 influenza vaccination prior to or upon service initiation or as
21 soon as practicable if vaccine supplies are not available at
22 the time of the service initiation, unless the vaccine is
23 medically contraindicated or the client has refused the
24 vaccine. If the Advisory Committee on Immunization Practices of
25 the Centers for Disease Control and Prevention determines that
26 dates of administration other than those stated in this Section
27 are optimal to protect the health of clients, the Department
28 may adopt rules to mandate vaccinations at those times rather
29 than the times stated in this Section. A home health agency
30 shall document in the client's medical record that an annual
31 vaccination against influenza was administered, refused, or
32 medically contraindicated.

1     (b) A home health agency shall provide or arrange for
2 administration of a pneumococcal vaccination, in accordance
3 with the recommendations of the Advisory Committee on
4 Immunization Practices of the Centers for Disease Control and
5 Prevention, to each client who is age 65 or over and who has
6 not received this immunization prior to or upon service
7 initiation, unless the client refuses the offer for vaccination
8 or the vaccination is medically contraindicated. A home health
9 agency shall document in each client's medical record that a
10 vaccination against pneumococcal pneumonia was offered and was
11 administered, refused, or medically contraindicated.
 
12     Section 99. Effective date. This Act takes effect upon
13 becoming law.
