    Amends the Mental Health Treatment Preference Declaration Act. Makes a technical change in a Section concerning a declaration of preference or instructions regarding mental health treatment.

1     AN ACT concerning civil law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Mental Health Treatment Preference
5 Declaration Act is amended by changing Section 10 as follows:
 
6     (755 ILCS 43/10)
7     Sec. 10. Declaration of preference or instructions.
8     (1) An adult of sound mind may make a declaration of
9 preferences or instructions regarding mental health treatment.
10 The The preferences or instructions may include consent to or
11 refusal of mental health treatment.
12     (2) A declaration for mental health treatment may be
13 invoked within 3 years of its execution unless it is revoked.
14 The authority of a named attorney-in-fact and any alternative
15 attorney-in-fact named in the declaration continues in effect
16 as long as the declaration appointing the attorney-in-fact is
17 in effect or until the attorney-in-fact has withdrawn. If a
18 declaration for mental health treatment has been invoked and is
19 in effect at the expiration of 3 years after its execution, the
20 declaration remains effective until the principal is no longer
21 incapable.
