| AN ACT concerning public aid.
|

| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Illinois Public Aid Code is amended by |
| 5 |
| changing Section 10-10.1 as follows:
|
| 6 |
| (305 ILCS 5/10-10.1) (from Ch. 23, par. 10-10.1)
|

| Sec. 10-10.1. Public Aid Collection Fee. In all cases |
| 8 |
| instituted by the
the
Illinois Department on behalf of a child |
| 9 |
| or spouse, other than one receiving
a grant of financial aid |
| 10 |
| under Article IV, on whose behalf an application
has been made |
| 11 |
| and approved for child support enforcement services as
provided |
| 12 |
| by Section 10-1,
the court shall impose a collection fee on the |
| 13 |
| individual who owes a child
or spouse support obligation in an |
| 14 |
| amount equal to 10% of the amount so
owed as long as such |
| 15 |
| collection is required by federal law, which fee shall
be in |
| 16 |
| addition to the support obligation. The imposition
of such fee |
| 17 |
| shall be in accordance with provisions of Title IV, Part D,
of |
| 18 |
| the Social Security Act and regulations duly promulgated |
| 19 |
| thereunder.
The fee shall be payable to the clerk of the |
| 20 |
| circuit court for transmittal
to the Illinois Department and |
| 21 |
| shall continue until child support
enforcement services are
|
| 22 |
| terminated by the Department. |
