AMENDMENT TO SENATE BILL 622

2     AMENDMENT NO. ______. Amend Senate Bill 622 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Mental Health and Developmental
5 Disabilities Administrative Act is amended by adding Section
6 54.5 as follows:
 
7     (20 ILCS 1705/54.5 new)
8     Sec. 54.5. Rates; community-based residential programs for
9 persons with developmental disabilities.
10     (a) As used in this Section, "community-based residential
11 program" means one of a variety of living arrangements for
12 persons with developmental disabilities in which no more than 4
13 individuals reside together in a setting designed to promote
14 independence and in which each such individual has his or her
15 own private bedroom. The term includes existing settings, such
16 as community integrated living arrangements, community
17 residential alternatives, assisted residential care, supported
18 residential care, and adult foster care, and may also include
19 newly developed settings that are consistent with this
20 definition.
21     (b) For the State fiscal year beginning July 1, 2006, the
22 Department shall reimburse each provider of community-based
23 residential program services at a rate equal to 100% of the
24 provider's costs of providing those services. For the State

1 fiscal year beginning July 1, 2007 and for each State fiscal
2 year thereafter, the Department shall add to the reimbursement
3 otherwise paid to each such provider under this Section an
4 annual cost-of-doing-business adjustment in accordance with
5 the most recent Implicit Price Deflator for the Gross Domestic
6 Product as computed and published by the U.S. Department of
7 Commerce.
8     (c) The purpose of this Section is to broaden consumers'
9 choices of community-based residential program services for
10 persons with developmental disabilities.
 
11     Section 99. Effective date. This Act takes effect upon
12 becoming law.".
