    Amends the Department of Commerce and Economic Opportunity Law. Provides that the Department of Commerce and Economic Opportunity shall award grants from the Promoting Community Safety Fund to certain entities to prepare prisoners and former prisoners for the work force and to provide supportive services for their reintegration into the community. States that the purpose of the grants is to enable organizations and persons to conduct educational and vocational training, to provide prisoner support groups, and for research on issues relating to prisoners and former prisoners. Creates the Promoting Community Safety Fund and provides for the Fund's operation. Provides that transfers shall be made into the Fund by the Department of Revenue from the Promoting Safety Fund Tax Check-off and other sources. Provides for the creation of a grant advisory committee and identifies certain entities who shall be members of the committee. Amends the State Finance Act to create the Promoting Community Safety Fund. Amends the Illinois Income Tax Act to create the Promoting Community Safety Fund Tax Check-off.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Commerce and Economic
5 Opportunity Law of the Civil Administrative Code of Illinois is
6 amended by adding Section 605-880 as follows:
 
7     (20 ILCS 605/605-880 new)
8     Sec. 605-880. Community safety grants; Promoting Community
9 Safety Fund; advisory committee.
10     (a) The Department of Commerce and Economic Opportunity
11 shall award grants from the Promoting Community Safety Fund to
12 eligible community, education, and other institutions and
13 persons to prepare prisoners and former prisoners for the work
14 force and to provide supportive services for their
15 reintegration into the community. The purpose of these grants
16 shall be to enable organizations and persons to conduct
17 educational and vocational training, to provide prisoner
18 support groups, and for research on issues relating to
19 prisoners and former prisoners. For purposes of this Section,
20 "research" includes, but is not limited to, expenditures to
21 develop and advance the understanding, training, and
22 modalities effective in program evaluation, best practices,
23 and curriculum development.
24     (b) The Promoting Community Safety Fund is created as a
25 special Fund in the State treasury. This Fund shall be used,
26 subject to appropriation, for making the grants described in
27 subsection (a) of this Section. Transfers shall be made into
28 the Fund by the Department of Revenue from the promoting
29 community safety tax-checkoff. Moneys from gifts, donations,
30 appropriations, and other legal sources shall also be deposited
31 into the Fund. Income earned on moneys in the Fund shall be
32 deposited into the Fund.

1     (c) The Department shall create a grant advisory committee
2 for the purpose of determining grant awards under this Section.
3 The Committee shall consist of members who are familiar with
4 the issues affecting prisoners and former prisoners and shall
5 include members from, but not limited to:
6         (1) The Illinois African-American Family Commission;
7         (2) the John Howard Association;
8         (3) The Jane Addams College of Social Work, University
9     of Illinois at Chicago;
10         (4) The Department of Criminal Justice, University of
11     Illinois at Chicago;
12         (5) the Department of Criminal Justice, Loyola
13     University at Chicago;
14         (6) the Illinois Task Force for Children of Prisoners,
15     Children of Promise; and
16         (7) the Illinois Prisoner Review Board.
17 Members of the advisory committee shall not be eligible for any
18 financial compensation or reimbursement.
19     (d) The Department shall adopt rules to implement and
20 administer this Section.
 
21     Section 10. The State Finance Act is amended by adding
22 Section 5.640 as follows:

24     Sec. 5.640. The Promoting Community Safety Fund.
 
25     Section 15. The Illinois Income Tax Act is amended by
26 changing Sections 509 and 510 and by adding Section 507EE as
27 follows:
 
28     (35 ILCS 5/507EE new)
29     Sec. 507EE. The Promoting Community Safety Fund Tax
30 Check-off. Beginning with the taxable year ending on December
31 31, 2005, the Department shall print on its standard individual
32 income tax form a provision indicating that if the taxpayer

1 wishes to contribute to the Promoting Community Safety Fund as
2 authorized under this amendatory Act of the 94th General
3 Assembly, he or she may do so be stating the amount of the
4 contribution (not less than $1) on the return and that the
5 contribution will reduce the taxpayer's refund or increase the
6 amount of payment to accompany the return. Failure to remit any
7 amount of increased payment shall reduce the contribution
8 accordingly. This Section shall not apply to an amended return.

10     Sec. 509. Tax checkoff explanations. All individual income
11 tax return forms shall contain appropriate explanations and
12 spaces to enable the taxpayers to designate contributions to
13 the following funds: the Child Abuse Prevention Fund, the
14 Illinois Wildlife Preservation Fund (as required by the
15 Illinois Non-Game Wildlife Protection Act), the Alzheimer's
16 Disease Research Fund (as required by the Alzheimer's Disease
17 Research Act), the Assistance to the Homeless Fund (as required
18 by this Act), the Penny Severns Breast and Cervical Cancer
19 Research Fund, the National World War II Memorial Fund, the
20 Prostate Cancer Research Fund, the Lou Gehrig's Disease (ALS)
21 Research Fund, the Multiple Sclerosis Assistance Fund, the
22 Leukemia Treatment and Education Fund, the World War II
23 Illinois Veterans Memorial Fund, the Korean War Veterans
24 National Museum and Library Fund, the Illinois Military Family
25 Relief Fund, the Illinois Veterans' Homes Fund, the Promoting
26 Community Safety Fund, and the Asthma and Lung Research Fund.
27     Each form shall contain a statement that the contributions
28 will reduce the taxpayer's refund or increase the amount of
29 payment to accompany the return. Failure to remit any amount of
30 increased payment shall reduce the contribution accordingly.
31     If, on October 1 of any year, the total contributions to
32 any one of the funds made under this Section do not equal
33 $100,000 or more, the explanations and spaces for designating
34 contributions to the fund shall be removed from the individual
35 income tax return forms for the following and all subsequent

1 years and all subsequent contributions to the fund shall be
2 refunded to the taxpayer.

8     Sec. 510. Determination of amounts contributed. The
9 Department shall determine the total amount contributed to each
10 of the following: the Child Abuse Prevention Fund, the Illinois
11 Wildlife Preservation Fund, the Assistance to the Homeless
12 Fund, the Alzheimer's Disease Research Fund, the Penny Severns
13 Breast and Cervical Cancer Research Fund, the National World
14 War II Memorial Fund, the Prostate Cancer Research Fund, the
15 Illinois Military Family Relief Fund, the Lou Gehrig's Disease
16 (ALS) Research Fund, the Multiple Sclerosis Assistance Fund,
17 the Leukemia Treatment and Education Fund, the World War II
18 Illinois Veterans Memorial Fund, the Korean War Veterans
19 National Museum and Library Fund, the Illinois Veterans' Homes
20 Fund, the Promoting Community Safety Fund, and the Asthma and
21 Lung Research Fund; and shall notify the State Comptroller and
22 the State Treasurer of the amounts to be transferred from the
23 General Revenue Fund to each fund, and upon receipt of such
24 notification the State Treasurer and Comptroller shall
25 transfer the amounts.
