Amends the Department of Commerce and Economic Opportunity Law. Provides that the Department of Commerce and Economic Opportunity shall award grants from the Promoting Community Safety Fund to certain entities to prepare prisoners and former prisoners for the work force and to provide supportive services for their reintegration into the community. States that the purpose of the grants is to enable organizations and persons to conduct educational and vocational training, to provide prisoner support groups, and for research on issues relating to prisoners and former prisoners. Creates the Promoting Community Safety Fund and provides for the Fund's operation. Provides that transfers shall be made into the Fund by the Department of Revenue from the Promoting Safety Fund Tax Check-off and other sources. Provides for the creation of a grant advisory committee and identifies certain entities who shall be members of the committee. Amends the State Finance Act to create the Promoting Community Safety Fund. Amends the Illinois Income Tax Act to create the Promoting Community Safety Fund Tax Check-off.

AN ACT concerning State government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois is amended by adding Section 605-880 as follows:

Sec. 605-880. Community safety grants; Promoting Community Safety Fund; advisory committee.

(a) The Department of Commerce and Economic Opportunity shall award grants from the Promoting Community Safety Fund to eligible community, education, and other institutions and persons to prepare prisoners and former prisoners for the work force and to provide supportive services for their reintegration into the community. The purpose of these grants shall be to enable organizations and persons to conduct educational and vocational training, to provide prisoner support groups, and for research on issues relating to prisoners and former prisoners. For purposes of this Section, "research" includes, but is not limited to, expenditures to develop and advance the understanding, training, and modalities effective in program evaluation, best practices, and curriculum development.

(b) The Promoting Community Safety Fund is created as a special Fund in the State treasury. This Fund shall be used, subject to appropriation, for making the grants described in subsection (a) of this Section. Transfers shall be made into the Fund by the Department of Revenue from the promoting community safety tax-checkoff. Moneys from gifts, donations, appropriations, and other legal sources shall also be deposited into the Fund. Income earned on moneys in the Fund shall be deposited into the Fund.

(c) The Department shall create a grant advisory committee for the purpose of determining grant awards under this Section. The Committee shall consist of members who are familiar with the issues affecting prisoners and former prisoners and shall include members from, but not limited to:

(1) The Illinois African-American Family Commission;

(2) the John Howard Association;

(3) The Jane Addams College of Social Work, University of Illinois at Chicago;

(4) The Department of Criminal Justice, University of Illinois at Chicago;

(5) the Department of Criminal Justice, Loyola University at Chicago;

(6) the Illinois Task Force for Children of Prisoners, Children of Promise; and

(7) the Illinois Prisoner Review Board. Members of the advisory committee shall not be eligible for any financial compensation or reimbursement.

(d) The Department shall adopt rules to implement and administer this Section.

Section 10. The State Finance Act is amended by adding Section 5.640 as follows:

Sec. 5.640. The Promoting Community Safety Fund.

Section 15. The Illinois Income Tax Act is amended by changing Sections 509 and 510 and by adding Section 507EE as follows:

Sec. 507EE. The Promoting Community Safety Fund Tax Check-off. Beginning with the taxable year ending on December 31, 2005, the Department shall print on its standard individual income tax form a provision indicating that if the taxpayer wishes to contribute to the Promoting Community Safety Fund as authorized under this amendatory Act of the 94th General Assembly, he or she may do so be stating the amount of the contribution (not less than $1) on the return and that the contribution will reduce the taxpayer's refund or increase the amount of payment to accompany the return. Failure to remit any amount of increased payment shall reduce the contribution accordingly. This Section shall not apply to an amended return.

Sec. 509. Tax checkoff explanations. All individual income tax return forms shall contain appropriate explanations and spaces to enable the taxpayers to designate contributions to the following funds: the Child Abuse Prevention Fund, the Illinois Wildlife Preservation Fund (as required by the Illinois Non-Game Wildlife Protection Act), the Alzheimer's Disease Research Fund (as required by the Alzheimer's Disease Research Act), the Assistance to the Homeless Fund (as required by this Act), the Penny Severns Breast and Cervical Cancer Research Fund, the National World War II Memorial Fund, the Prostate Cancer Research Fund, the Lou Gehrig's Disease (ALS) Research Fund, the Multiple Sclerosis Assistance Fund, the Leukemia Treatment and Education Fund, the World War II Illinois Veterans Memorial Fund, the Korean War Veterans National Museum and Library Fund, the Illinois Military Family Relief Fund, the Illinois Veterans' Homes Fund, the Promoting Community Safety Fund, and the Asthma and Lung Research Fund.

Each form shall contain a statement that the contributions will reduce the taxpayer's refund or increase the amount of payment to accompany the return. Failure to remit any amount of increased payment shall reduce the contribution accordingly.

If, on October 1 of any year, the total contributions to any one of the funds made under this Section do not equal $100,000 or more, the explanations and spaces for designating contributions to the fund shall be removed from the individual income tax return forms for the following and all subsequent years and all subsequent contributions to the fund shall be refunded to the taxpayer.

Sec. 510. Determination of amounts contributed. The Department shall determine the total amount contributed to each of the following: the Child Abuse Prevention Fund, the Illinois Wildlife Preservation Fund, the Assistance to the Homeless Fund, the Alzheimer's Disease Research Fund, the Penny Severns Breast and Cervical Cancer Research Fund, the National World War II Memorial Fund, the Prostate Cancer Research Fund, the Illinois Military Family Relief Fund, the Lou Gehrig's Disease (ALS) Research Fund, the Multiple Sclerosis Assistance Fund, the Leukemia Treatment and Education Fund, the World War II Illinois Veterans Memorial Fund, the Korean War Veterans National Museum and Library Fund, the Illinois Veterans' Homes Fund, the Promoting Community Safety Fund, and the Asthma and Lung Research Fund; and shall notify the State Comptroller and the State Treasurer of the amounts to be transferred from the General Revenue Fund to each fund, and upon receipt of such notification the State Treasurer and Comptroller shall transfer the amounts.
