AMENDMENT TO SENATE BILL 508

2     AMENDMENT NO. ______. Amend Senate Bill 508 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Highway Code is amended by adding
5 Section 4-220 as follows:
 
6     (605 ILCS 5/4-220 new)
7     Sec. 4-220. Accommodation of all roadway users.
8     (a) The General Assembly finds that it is the public policy
9 of this State that Department of Transportation projects must
10 adequately meet the transportation needs of all roadway users,
11 including those who travel along or across State roadways by
12 motor vehicle, foot, bicycle, or wheelchair.
13     (b) To support this policy and to meet the intent of
14 federal transportation law, the Department shall adopt the
15 Federal Highway Administration's "Accommodating Bicycle and
16 Pedestrian Travel" policy in a manner consistent with Illinois
17 law. The federal policy requires the routine inclusion of
18 bicycling and walking facilities in all projects except where
19 there is an absence of need, where cost limits are exceeded,
20 where bicyclists and pedestrians are prohibited, or where other
21 exceptional circumstances exist.
22     This policy does not apply to pavement resurfacing projects
23 that are in progress on January 1, 2006 and that do not widen
24 the existing roadway and do not provide stabilized shoulders,

1 unless (i) local support is evident or (ii) bicycling and
2 walking accommodations can be added within the overall scope of
3 the original roadwork.
4     This policy shall become effective July 1, 2006 for
5 planning and training purposes only. For construction
6 projects, this policy shall become effective July 1, 2007.
7     (c) The Department shall file with the Governor and the
8 General Assembly, no later than March 1, 2007, a report
9 containing an evaluation of existing bicycle and pedestrian
10 accommodation in State roadway projects and a comparison of
11 these projects with federal guidelines and the best practices
12 of other states.
13     (d) The Department shall, no later than March 1, 2007,
14 submit to the Governor and the General Assembly a transition
15 plan for:
16         (1) specific policy and implementation changes
17     identified in the report and;
18         (2) training on bicycle and pedestrian accommodation
19     for all Department staff and contractors involved in
20     roadway planning and design.
21     (e) The Department shall report to the Governor and the
22 General Assembly, on March 1, 2007 and on March 1 of every
23 succeeding odd-numbered year, on the status of all planning and
24 construction projects that have included pedestrian,
25 wheelchair, and bicycle components. This reporting requirement
26 may be consolidated with other Department reporting
27 requirements to Governor and the General Assembly, if the
28 information required is distinctly available within the
29 reports.".
