Amends the Illinois Highway Code. Provides that it is the public policy of the State that Department of Transportation projects must accommodate the needs of all highway users, including travelers on roadways by motor vehicle, foot, bicycle, or wheel chair. Provides that the Department shall provide periodic reports to the Governor and the General Assembly regarding the accommodation of these projects to the needs of bicyclists and pedestrians.

| AN ACT concerning transportation.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Highway Code is amended by adding |
5 |
| Section 4-220 as follows: |
6 |
| (605 ILCS 5/4-220 new) |
7 |
| Sec. 4-220. Accommodation of all roadway users. |
8 |
| (a) The General Assembly finds that is the public policy of |
9 |
| this State that Department of Transportation projects must |
10 |
| adequately meet the transportation needs of all roadway users, |
11 |
| including those who travel along or across State roadways by |
12 |
| motor vehicle, foot, bicycle, or wheelchair. |
13 |
| (b) To support this policy and to meet the intent of |
14 |
| federal transportation law, the Department shall adopt the |
15 |
| Federal Highway Administration's "Accommodating Bicycle and |
16 |
| Pedestrian Travel" policy in a manner consistent with Illinois |
17 |
| law. This policy requires the routine inclusion of bicycling |
18 |
| and walking facilities in all projects where they are or might |
19 |
| in the future be needed, unless cost limits are exceeded or |
20 |
| other exceptional circumstances exist. |

| (c) The Department shall file with the Governor and the |
22 |
| General Assembly, no later than March 1, 2006, a report |
23 |
| containing an evaluation of existing bicycle and pedestrian |
24 |
| accommodation in State roadway projects and a comparison of |
25 |
| these projects with federal guidelines and the best practices |
26 |
| of other states. |

| (d) The Department shall, no later than March 1, 2006, |
28 |
| submit to the Governor and the General Assembly a transition |
29 |
| plan for: |
30 |
| (i) specific policy and implementation changes |
31 |
| identified in the report and; |
32 |
| (ii) training on bicycle and pedestrian accommodation |
