Amends the Illinois Vehicle Code. Provides that, beginning January 1, 2006, all diesel powered vehicles owned or operated by the State, any unit of local government, or any State College or University, as well as all diesel powered Chicago Transit Authority, Pace, and METRA vehicles, must, when refueling at a bulk central fueling facility, use a blend containing at least 2% biodiesel fuel, where available. Provides that the Secretary of Transportation shall adopt rules for implementing the provision. Effective immediately.

| AN ACT concerning transportation.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Vehicle Code is amended by adding |
5 |
| Section 12-705.1 as follows: |
6 |
| (625 ILCS 5/12-705.1 new)
|

| Sec. 12-705.1. Required use of biodiesel by certain |
8 |
| vehicles. |
9 |
| (a) Beginning January 1, 2006, any diesel powered vehicle |
10 |
| owned or operated by this State, any unit of local government, |
11 |
| or any State College or University, as well as any diesel |
12 |
| powered Chicago Transit Authority, Pace, or METRA vehicle, |
13 |
| must, when refueling at a bulk central fueling facility, use a |
14 |
| biodiesel blend that contains no less than 2% biodiesel, as |
15 |
| those terms are defined in the Illinois Renewable Fuels |
16 |
| Development Program Act, where available. |
17 |
| (b) The Secretary of Transportation shall adopt rules for |
18 |
| implementing this Section.

| Section 99. Effective date. This Act takes effect upon |
20 |
| becoming law.
|
