Amends the Illinois Vehicle Code. Provides that a vehicle of the first division may not be seized or impounded solely on the basis of a violation of the provision requiring prevention of excessive or unusual noise. Effective immediately.

| AN ACT concerning transportation.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Vehicle Code is amended by changing |
5 |
| Section 12-602 as follows:
|
6 |
| (625 ILCS 5/12-602) (from Ch. 95 1/2, par. 12-602)

| Sec. 12-602. Mufflers, prevention of noise.
|
8 |
| (a) Every motor vehicle driven or operated upon the |
9 |
| highways of this State
shall at all times be equipped with an |
10 |
| adequate muffler or exhaust system
in constant operation and |
11 |
| properly maintained to prevent any excessive or
unusual noise. |
12 |
| No such muffler or exhaust system shall be equipped with a
|
13 |
| cutout, bypass or similar device. No person shall modify the |
14 |
| exhaust system
of a motor vehicle in a manner which will |
15 |
| amplify or increase the noise of
such vehicle above that |
16 |
| emitted by the muffler originally installed on the
vehicle, and |
17 |
| such original muffler shall comply with all the requirements
of |
18 |
| this Section. |

| (b) A vehicle of the first division may not be seized or |
20 |
| impounded solely on the basis of a violation of this Section.

| Section 99. Effective date. This Act takes effect upon |

| becoming law.
