Amends the Illinois Vehicle Code. Provides that a person who holds an instruction permit or a graduated license may not use a wireless phone while driving a vehicle. Provides that the prohibition does not apply to use of a wireless phone to contact a law enforcement agency, health care provider, or emergency services agency for emergency purposes. Effective immediately.

| AN ACT concerning transportation.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Vehicle Code is amended by adding |
5 |
| Section 12-610.1 as follows: |

| (625 ILCS 5/12-610.1 new) |

| Sec. 12-610.1. Wireless telephones. |
8 |
| (a) As used in this Section, "wireless telephone" means
a |
9 |
| device that is capable of transmitting or receiving
telephonic |
10 |
| communications without a wire connecting the
device to the |
11 |
| telephone network. |

| (b) A person who holds an instruction permit issued under |
13 |
| Section 6-105 or 6-107.1, or a person who holds a graduated |
14 |
| license issued under Section 6-107, may not drive a vehicle |
15 |
| while using a wireless phone.
|

| (c) This Section does not apply to a person using a
|
17 |
| wireless telephone for emergency purposes, including, but not
|
18 |
| limited to, an emergency call to a law enforcement agency,
|
19 |
| health care provider, fire department, or other emergency
|
20 |
| services agency or entity.
|
21 |
| Section 99. Effective date. This Act takes effect upon |
22 |
| becoming law.
