Amends the Illinois Public Aid Code. Provides that under the Medicaid program, the Department of Public Aid may not establish formulary limits on, or restrict by any prior authorization requirement, any prescription drug or laboratory or diagnostic test as prescribed and determined to be medically necessary for the treatment of patients diagnosed with hepatitis C. Effective immediately.

| AN ACT concerning public aid.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Public Aid Code is amended by |
5 |
| adding Section 5-5.12b as follows: |
6 |
| (305 ILCS 5/5-5.12b new) |
7 |
| Sec. 5-5.12b. Hepatitis C; no formulary limits or prior |
8 |
| authorization. The Department of Public Aid may not establish |
9 |
| formulary limits on, or restrict by any prior authorization |
10 |
| requirement, any prescription drug or laboratory or diagnostic |
11 |
| test as prescribed and determined to be medically necessary for |
12 |
| the treatment of patients diagnosed with hepatitis C. The |
13 |
| Department of Public Aid shall make all exemptions and |
14 |
| exclusions from formulary limitations identified in this |
15 |
| Section applicable to all agencies, departments, and programs |
16 |
| under its jurisdiction.

| Section 99. Effective date. This Act takes effect upon |
18 |
| becoming law.
