| AN ACT concerning procurement.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Procurement Code is amended by |
5 |
| changing Section
45-20 as follows:
|

| (30 ILCS 500/45-20)
|
7 |
| Sec. 45-20. Recycled materials.
|
8 |
| (a) Except as provided in subsection (b), when a public |
9 |
| contract is to
be awarded to the lowest responsible bidder, an |
10 |
| otherwise qualified bidder who
will fulfill the contract |
11 |
| through the use of products made of recycled
materials may, on |
12 |
| a pilot basis or in accordance with a pilot study, be given
|
13 |
| preference over other bidders unable to do so, provided that |
14 |
| the cost included
in the bid of products made of recycled |
15 |
| materials is not more than 10% greater
than the cost of |
16 |
| products not made of recycled materials.
|
17 |
| (b) A contract for the purchase of asphalt or that includes |
18 |
| the use or
provision of asphalt must be performed with asphalt |
19 |
| made of recycled asphalt
and recycled tires,
except that this |
20 |
| subsection shall not be construed to require the procurement
of |
21 |
| asphalt
that does not perform adequately for its intended end |
22 |
| use or is not available
at a
reasonable price in a reasonable |
23 |
| period of time.
