AMENDMENT TO HOUSE BILL 5416

2     AMENDMENT NO. ______. Amend House Bill 5416 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The School Code is amended by changing Sections
5 2-3.137 (added by Public Act 94-225) and 3-14.20 as follows:
 
6     (105 ILCS 5/2-3.137)
7     Sec. 2-3.137. Inspection and review of school facilities;
8 task force.
9     (a) The State Board of Education shall adopt rules for the
10 documentation of school plan reviews and inspections of school
11 facilities, including the responsible individual's signature.
12 Such documents shall be kept on file by the regional
13 superintendent of schools. The State Board of Education shall
14 also adopt rules for the qualifications of persons performing
15 the reviews and inspections, which must be consistent with the
16 recommendations in the task force's report issued to the
17 Governor and the General Assembly under subsection (b) of this
18 Section.
19     (b) The State Board of Education shall convene a task force
20 for the purpose of reviewing the documents required under rules
21 adopted under subsection (a) of this Section and making
22 recommendations regarding training and accreditation of
23 individuals performing reviews or inspections required under
24 Section 2-3.12, 3-14.20, 3-14.21, or 3-14.22 of this Code,

1 including regional superintendents of schools and others
2 performing reviews or inspections under the authority of a
3 regional superintendent (such as consultants, municipalities,
4 and fire protection districts).
5     The task force shall consist of all of the following
6 members:
7         (1) The Executive Director of the Capital Development
8     Board or his or her designee and a staff representative of
9     the Division of Building Codes and Regulations.
10         (2) The State Superintendent of Education or his or her
11     designee.
12         (3) A person appointed by the State Board of Education.
13         (4) A person appointed by an organization representing
14     school administrators.
15         (5) A person appointed by an organization representing
16     suburban school administrators and school board members.
17         (6) A person appointed by an organization representing
18     architects.
19         (7) A person appointed by an organization representing
20     regional superintendents of schools.
21         (8) A person appointed by an organization representing
22     fire inspectors.
23         (9) A person appointed by an organization representing
24     Code administrators.
25         (10) A person appointed by an organization
26     representing plumbing inspectors.
27         (11) A person appointed by an organization that
28     represents both parents and teachers.
29         (12) A person appointed by an organization
30     representing municipal governments in the State.
31         (13) A person appointed by the State Fire Marshal from
32     his or her office.
33         (14) A person appointed by an organization
34     representing fire chiefs.

1         (15) The Director of Public Health or his or her
2     designee.
3         (16) A person appointed by an organization
4     representing structural engineers.
5         (17) A person appointed by an organization
6     representing professional engineers.
7     The task force shall issue a report of its findings to the
8 Governor and the General Assembly no later than January 1,
9 2006.

11     (105 ILCS 5/3-14.20)   (from Ch. 122, par. 3-14.20)
12     Sec. 3-14.20. Building plans and specifications. To
13 inspect the building plans and specifications, including but
14 not limited to plans and specifications for the heating,
15 ventilating, lighting, seating, water supply, toilets and
16 safety against fire of public school rooms and buildings
17 submitted to him by school boards, and to approve all those
18 which comply substantially with the building code authorized in
19 Section 2-3.12.
20     If a municipality or, in the case of an unincorporated
21 area, a county or, if applicable, a fire protection district
22 wishes to be notified of plans and specifications received by a
23 regional office of education for any future construction or
24 alteration of a public school facility located within that
25 entity's jurisdiction, then the entity must register this wish
26 with the regional superintendent of schools. Within 10 days
27 after the regional superintendent of schools receives the plans
28 and specifications from a school board and prior to the bidding
29 process, he or she shall notify, in writing, the registered
30 municipality and, if applicable, the registered fire
31 protection district where the school that is being constructed
32 or altered lies that plans and specifications have been
33 received. In the case of an unincorporated area, the registered

1 county shall be notified. If the municipality, fire protection
2 district, or county requests a review of the plans and
3 specifications, then the school board shall submit a copy of
4 the plans and specifications. The municipality and, if
5 applicable, the fire protection district or the county may
6 comment in writing on the plans and specifications based on the
7 building code authorized in Section 2-3.12, referencing the
8 specific code where a discrepancy has been identified, and
9 respond back to the regional superintendent of schools within
10 15 days after a copy of the plans and specifications have been
11 received or, if needed for plan review, such additional time as
12 agreed to by the regional superintendent of schools. This
13 review must be at no cost to the school district.
14     If such plans and specifications are not approved or denied
15 approval by the regional superintendent of schools within 3
16 months after the date on which they are submitted to him or
17 her, the school board may submit such plans and specifications
18 directly to the State Superintendent of Education for approval
19 or denial.
20     Inspections of school construction and alterations may be
21 performed by qualified construction inspectors acting on
22 behalf of municipalities or, if applicable, counties or fire
23 protection districts who register with the regional
24 superintendent of schools. These inspections must be based on
25 the model building codes referenced in the Health/Life Safety
26 Code for Public Schools.
