AMENDMENT TO HOUSE BILL 5386

2     AMENDMENT NO. ______. Amend House Bill 5386 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Public Aid Code is amended by
5 adding Section 5-5e as follows:
 
6     (305 ILCS 5/5-5e new)
7     Sec. 5-5e. Waiver for home and community-based services for
8 children with developmental disabilities or autism spectrum
9 disorder. The Department of Healthcare and Family Services
10 shall apply for a waiver or waivers from the United States
11 Centers for Medicare and Medicaid Services pursuant to Section
12 1915(c) of the Social Security Act no later than June 1, 2006,
13 or as soon thereafter as practicable, to allow payment for
14 in-home and community-based treatment, therapies, training
15 including parent training, and other necessary aids and
16 services for children from the age of 3 up to the age of 21 who
17 are diagnosed with a developmental disability or autism
18 spectrum disorder, including those children whose families
19 would not otherwise qualify for medical assistance under this
20 Article due to family income or assets. The application or
21 applications shall request an implementation date of January 1,
22 2007, or as soon thereafter as may be approved by the United
23 States Centers for Medicare and Medicaid Services, and shall
24 provide for: (i) a minimum of 800 children in the first year of

1 implementation, of which no fewer than 500 shall be children
2 with autism spectrum disorder; (ii) a minimum of 1,750 children
3 in the second year of implementation, of which no fewer than
4 1,000 shall be children with autism spectrum disorder; and
5 (iii) a minimum of 3,350 in the third and subsequent years of
6 implementation, of which 2,000 shall be children with autism
7 spectrum disorder.
 
8     Section 99. Effective date. This Act takes effect upon
9 becoming law.".
