1 | AN ACT concerning education.

2 | Be it enacted by the People of the State of Illinois, | ||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The School Code is amended by changing Section | ||||||||||||||||||||||||
5 | 2-3.25d as follows:
| ||||||||||||||||||||||||

7 | Sec. 2-3.25d. Academic early warning and watch status.
| ||||||||||||||||||||||||
8 | (a) Beginning with the 2005-2006 school year, unless the | ||||||||||||||||||||||||
9 | federal government formally disapproves of such policy through | ||||||||||||||||||||||||
10 | the submission and review process for the Illinois | ||||||||||||||||||||||||
11 | Accountability Workbook, those
schools that do not meet | ||||||||||||||||||||||||
12 | adequate yearly progress criteria for 2 consecutive annual
| ||||||||||||||||||||||||
13 | calculations for the percentage meeting or exceeding standards
| ||||||||||||||||||||||||
14 | in the same subgroup and in the same subject or in their | ||||||||||||||||||||||||
15 | participation rate for the same subgroup and in the same | ||||||||||||||||||||||||
16 | subject or in their , attendance rate , or graduation rate
shall | ||||||||||||||||||||||||
17 | be placed on academic early warning status for the next school | ||||||||||||||||||||||||
18 | year.
Schools on academic early warning status that do not meet | ||||||||||||||||||||||||
19 | adequate yearly
progress criteria for a third annual | ||||||||||||||||||||||||
20 | calculation for the percentage meeting or exceeding standards
| ||||||||||||||||||||||||
21 | in the same subgroup and in the same subject or in their | ||||||||||||||||||||||||
22 | participation rate for the same subgroup and in the same | ||||||||||||||||||||||||
23 | subject or in their , attendance rate , or graduation rate
shall | ||||||||||||||||||||||||
24 | remain on academic early
warning status. Schools on academic | ||||||||||||||||||||||||
25 | early warning status that do not meet
adequate yearly progress | ||||||||||||||||||||||||
26 | criteria for a fourth annual calculation for the percentage | ||||||||||||||||||||||||
27 | meeting or exceeding standards in the same subgroup and in the | ||||||||||||||||||||||||
28 | same subject or in their participation rate for the same | ||||||||||||||||||||||||
29 | subgroup and in the same subject or in their , attendance rate ,
| ||||||||||||||||||||||||
30 | or graduation rate shall be
placed
on initial academic watch | ||||||||||||||||||||||||
31 | status. Schools on academic watch status that do not
meet | ||||||||||||||||||||||||
32 | adequate yearly progress criteria for a fifth or subsequent |

calculation for the percentage meeting or exceeding | ||||||
2 | standards in the same subgroup and in the same subject or in | ||||||
3 | their participation rate for the same subgroup and in the same | ||||||

5 | remain on academic watch status. Schools on academic early
| ||||||
6 | warning or academic watch status that meet adequate yearly | ||||||
7 | progress criteria
for
one annual calculation
shall be | ||||||
8 | considered as having
met
expectations and shall be removed from | ||||||
9 | any status designation.
| ||||||
10 | The school district of a school placed on either academic | ||||||
11 | early warning
status or academic watch status may appeal the | ||||||
12 | status to the State Board of
Education in accordance with | ||||||
13 | Section 2-3.25m of this Code.
| ||||||
14 | A school district that has one or more schools on academic | ||||||
15 | early warning
or academic watch status shall prepare a revised | ||||||
16 | School Improvement Plan or
amendments thereto setting forth the | ||||||
17 | district's expectations for removing each
school from academic | ||||||
18 | early warning or academic watch status and for improving
| ||||||
19 | student performance in the affected school or schools. | ||||||
20 | Districts operating
under
Article 34 of this Code may prepare | ||||||
21 | the School Improvement Plan required under
Section 34-2.4 of | ||||||
22 | this Code.
| ||||||
23 | The revised School Improvement Plan for a school
that is | ||||||
24 | initially placed on academic early warning status
or that | ||||||
25 | remains on
academic early warning status after a third annual | ||||||
26 | calculation
must be approved by
the
school board (and by the | ||||||
27 | school's local school council in a district operating
under | ||||||
28 | Article 34 of this Code, unless the school is on probation | ||||||
29 | pursuant to
subsection (c) of Section
34-8.3 of this Code).

30 | The revised School Improvement Plan for a school placed on | ||||||
31 | initial
academic watch status after a fourth annual calculation | ||||||
32 | must be approved by the
school board (and by the school's local | ||||||
33 | school council in a district operating
under Article 34 of this | ||||||
34 | Code, unless the school is on probation pursuant to
subsection | ||||||
35 | (c) of Section
34-8.3 of this Code) and the State | ||||||
36 | Superintendent of Education.

3 | calculation must be approved by the
school board (and by the | ||||||
4 | school's local school council in a district operating
under | ||||||
5 | Article 34 of this Code, unless the school is on probation | ||||||
6 | pursuant to
subsection (c) of Section
34-8.3 of this Code) and | ||||||
7 | the State Superintendent of Education.
In addition, the | ||||||
8 | district must develop a school restructuring plan for the
| ||||||
9 | school that
must
be approved by the school board (and by the | ||||||
10 | school's local school council in a
district operating under | ||||||
11 | Article 34 of this Code) and subsequently approved by
the State | ||||||
12 | Superintendent of Education.
| ||||||
13 | A school on academic watch status that does not meet | ||||||
14 | adequate yearly
progress criteria for a sixth annual | ||||||
15 | calculation shall implement its approved
school restructuring | ||||||
16 | plan beginning with the next school year, subject to the
State
| ||||||
17 | interventions specified in Section 2-3.25f of this Code.
| ||||||

35 | The revised District Improvement Plan for a district that | ||||||
36 | remains on
academic watch status after a fifth annual |

1 | calculation must be approved by the
school board and the State | ||||||
2 | Superintendent of Education. In addition, the
district must
| ||||||
3 | develop a district restructuring plan that must be approved by | ||||||
4 | the school
board and the State Superintendent of Education.

5 | A district on academic watch status that does not meet | ||||||
6 | adequate yearly

11 | (c) All revised School and District Improvement Plans shall | ||||||
12 | be developed
in collaboration with staff in the affected school | ||||||
13 | or school district. All
revised
School and District Improvement | ||||||
14 | Plans shall be developed, submitted, and
approved pursuant to | ||||||
15 | rules adopted by the State Board of Education. The
revised | ||||||
16 | Improvement Plan shall address measurable outcomes for | ||||||
17 | improving
student performance so that such performance meets | ||||||
18 | adequate yearly progress
criteria as specified by the State | ||||||
19 | Board of Education.
| ||||||
20 | (d) All federal requirements apply to schools and school | ||||||
21 | districts utilizing
federal funds under Title I, Part A of the | ||||||
22 | federal Elementary and Secondary
Education Act of 1965. | ||||||
23 | (e) The State Board of Education, from any moneys it may | ||||||
24 | have available for this purpose, must implement
and administer | ||||||
25 | a grant
program that provides 2-year grants to school districts | ||||||
26 | on the academic watch
list and other school districts that have | ||||||
27 | the lowest achieving students, as
determined by the State Board | ||||||
28 | of Education, to be
used to improve student achievement.
In | ||||||
29 | order
to receive a
grant under this program, a school district | ||||||
30 | must establish an accountability
program. The
accountability | ||||||
31 | program must involve the use of statewide testing standards and
| ||||||
32 | local
evaluation measures. A grant shall be automatically | ||||||
33 | renewed when achievement
goals are met. The Board may adopt any | ||||||
34 | rules necessary to implement and
administer this grant program.

1 | Section 99. Effective date. This Act takes effect upon | ||||||
2 | becoming law.
