    Amends the Illinois Vehicle Code. Amends the Illinois Commercial Transportation Law to provide that any interstate carrier that is required to register under federal law is required to register with the Illinois Commerce Commission.

    AN ACT concerning transportation.

    Be it enacted by the People of the State of Illinois,
 
3
represented in the General Assembly:

    Section 5. The Illinois Vehicle Code is amended  by changing 
5
Sections 18c-4401 and 18c-4603 as follows:

    (625 ILCS 5/18c-4401)  (from Ch. 95 1/2, par. 18c-4401)

    Sec. 18c-4401. Registration required. 

8
    (1) General provisions. No intrastate public carrier and no 
9
interstate
motor carrier of property
shall operate over the 
10
public roads of this
State without a
registration issued 
11
pursuant to this Article and in effect at the
time operations 
12
are conducted. As used in this Article, "interstate carrier" 
13
includes any private carrier that is required to register under 
14
federal law.


15
    (2) Interstate intercorporate hauling and single-source 
16
leasing.
Persons or entities engaged in
interstate compensated 
17
intercorporate hauling, and interstate
private carriers which 
18
lease equipment, with drivers, are
interstate carriers for 
19
purposes of this Article notwithstanding any
other provision of 
20
this Chapter.
However, the Commission may:


21
        (a) Exempt such carriers from the requirements of this 
22
    Article;


23
        (b) Subject any such exemption to such reasonable terms 
24
    and conditions
as the Commission deems necessary to 
25
    effectuate the purposes of this Chapter;
and


26
        (c) Revoke any exemption granted hereunder if it deems 
27
    revocation
necessary to effectuate the purposes of this 
28
    Chapter.

    Sec. 18c-4603. Issuance of Cab Cards and Identifiers. (1)

Applications for Cards and Identifiers.
Applications for cab 
2
cards and identifiers shall be on forms
prescribed by the 
3
Commission and shall be accompanied by the
per vehicle 
4
franchise or franchise renewal fee prescribed by
the 
5
Commission.

    (2) Expiration and Renewal of Cab Cards and Identifiers. 
7
Identifiers
issued by or under authority of the
Commission 
8
shall expire automatically on January 31 of each
year, or on 
9
such other date as the Commission may prescribe.
It shall be 
10
the responsibility of each carrier to insure that
the cab cards 
11
and identifiers in its vehicles are current.

12
    (3) Issuance of Cards and Identifiers.
Applications and 
13
fees for cab cards and identifiers may be filed
with, and cards 
14
or identifiers may be issued by, the Commission or
its agent.

15
The Commission shall issue intrastate cab cards and identifiers 
16
and
interstate identifiers as proof of payment of franchise and 
17
franchise
renewal fees by licensed intrastate and registered 
18
interstate carriers.
Upon payment of the intrastate fee by a 
19
licensed intrastate motor carrier
of property, the Commission 
20
shall issue a current Illinois cab card with
identifier printed 
21
thereon.  Upon payment of the interstate fee by a
registered 
22
interstate motor carrier of property, the Commission shall 
23
issue
a current Illinois interstate identifier which the 
24
carrier shall affix to
the interstate cab card.
