SYNOPSIS AS INTRODUCED:
 
10 ILCS 5/9-6   from Ch. 46, par. 9-6

    Amends the Election Code. Requires that a campaign contributor of goods and services with a value of more than $150 (now, more than $50) must certify specified information to the receiving political committee. If the contributor fails to make the certification, requires the committee to make a good faith effort to obtain the information.

1     AN ACT concerning elections.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Election Code is amended by changing Section
5 9-6 as follows:
 
6     (10 ILCS 5/9-6)  (from Ch. 46, par. 9-6)
7     Sec. 9-6. Accounting for contributions.
8     (a) Every person who receives a contribution in excess of
9 $20 for a political committee shall, on demand of the
10 treasurer, and in any event within 5 days after receipt of such
11 contribution, render to the treasurer a detailed account
12 thereof, including the amount, the name and address of the
13 person making such contribution, and the date on which it was
14 received.
15     (b) Within 5 business days of contributing goods or
16 services of more than $150 $50 value to a political committee,
17 the contributor shall certify the value of the contribution to
18 the political committee on forms prescribed by the State Board
19 of Elections. The forms shall include the name and address of
20 the contributor, a description and market value of the goods or
21 services, and the date on which the contribution was made.
22     (b-5) A political committee in receipt of goods or services
23 valued at more than $150 that has not received the contributor
24 form described in subsection (b) within 5 business days after
25 receipt of the goods or services shall make a good faith effort
26 to obtain this form. A committee is deemed to be in receipt of
27 goods on the date the committee obtains possession of the goods
28 and is deemed to be in receipt of services on the date
29 information comes into possession of the candidate or the
30 chairman or treasurer of the political committee that the
31 services have been received. Good faith effort shall include an
32 obligation on the part of the political committee to contact

1 the contributor to obtain the required information. If the
2 contributor fails to provide the required information, the
3 political committee shall contact the vendor to obtain the
4 information. If the vendor fails to provide the information,
5 the political committee shall submit a written statement to the
6 State Board of Elections that the political committee has made
7 a good faith effort to obtain the information and shall provide
8 an estimate of the value of the goods or services received. The
9 committee must retain a written confirmation of its attempt or
10 attempts to contact the contributor and vendor for 2 years from
11 the date of receipt of the contribution.
12     (c) All funds of a political committee shall be segregated
13 from, and may not be commingled with, any personal funds of
14 officers, members, or associates of such committee.
