SYNOPSIS AS INTRODUCED:
 
215 ILCS 170/43 new

    Amends the Covering ALL KIDS Health Insurance Act. Permits dependent children between the ages of 19 and 23 to buy into the Covering ALL KIDS Health Insurance Program if the child (i) was enrolled in the Program prior to turning 19 years of age, (ii) is enrolled in a post-secondary education program full-time, and (iii) is eligible to be claimed as a dependent for income tax purposes. Authorizes the Department of Healthcare and Family Services to establish eligibility, co-pay, and premium requirements and requires to Department to take into consideration health benefits available to the child through the education program. Authorizes the Department to adopt rules to assist in paying premiums for health care coverage through the child's education program as an alternative to enrollment in the Program. Effective July 1, 2006.

1     AN ACT concerning insurance.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Covering ALL KIDS Health Insurance Act is
5 amended by adding Section 43 as follows:
 
6     (215 ILCS 170/43 new)
7     Sec. 43. Dependent children enrolled in education
8 programs.
9     (a) The Department may establish a buy-in option for the
10 Program for dependent children age 19 to 23 if that child (i)
11 was enrolled in the Program prior to turning 19 years of age,
12 (ii) is attending a post-secondary education program
13 full-time, including, but not limited to, a GED program,
14 community college, vocational/technical school, or 2 year or 4
15 year college, and (iii) is eligible to be claimed as a
16 dependent for income tax purposes.
17     A child eligible for the Program under this Section must
18 remain in good standing in the education program during the
19 entire time that the child is enrolled in the Program
20     (b) The Department may adopt rules necessary to establish
21 eligibility, co-pay, and premium requirements for children
22 enrolled in the Program under this Section. Health benefits
23 available to the dependent child through the education program
24 he or she is enrolled in must be taken into consideration when
25 determining a child's co-pay and premium.
26     (c) The Department may adopt rules to assist a child
27 eligible for the Program under this Section in paying premiums
28 for health care coverage through the child's education program
29 as an alternative to enrollment in the Program.
 
30     Section 99. Effective date. This Act takes effect on July
31 1, 2006.
