| AN ACT concerning criminal law.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Unified Code of Corrections is amended by |
5 |
| adding Section 3-14-4.5 as follows: |

| (730 ILCS 5/3-14-4.5 new) |

| Sec. 3-14-4.5. Private half-way houses. |
8 |
| (a) Any person or entity who intends to establish a |
9 |
| half-way house for the residence of persons on parole or |
10 |
| mandatory release from the Department of Corrections shall |
11 |
| comply with all applicable local zoning laws. |
12 |
| (b) Establishment or maintenance of a half-way house, other |
13 |
| than by the Department of Corrections, without complying with |
14 |
| all applicable local zoning laws is a Class A misdemeanor for |
15 |
| which the offender shall be fined $1,000 for every week that |
16 |
| the half-way house is in violation, in addition to any other |
17 |
| locally imposed fines. |

| (c) Not less than 15 days prior to the placement of a |
19 |
| person in such a half-way house, the half-way house shall give |
20 |
| written notice to the State's Attorney and the sheriff of the |
21 |
| county and the proper law enforcement agency of the |
22 |
| municipality in which the half-way house is located of the |
23 |
| identity of the person to be placed in that program. The |
24 |
| identifying information shall include, but not be limited to, |
25 |
| the name of the individual, age, physical description, |
26 |
| photograph, and the crime for which the person was originally |
27 |
| sentenced to the Department of Corrections. The notice shall be |
28 |
| given in all cases. |

| (d) Failure to comply with the notification requirements of |
30 |
| subsection (c) is a petty offense for which a $1,000 fine shall |
31 |
| be imposed for each offense.
