| AN ACT concerning State government.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Lottery Law is amended by changing |
5 |
| Sections 2 and 20 and by adding Section 21.7 as follows:
|

| Sec. 2. This Act is enacted to implement and establish |
8 |
| within the State
a lottery to be operated by the State, the |
9 |
| entire net proceeds of which
are to be used for the support of |
10 |
| the State's Common School Fund,
except as provided in Sections |
11 |
| 21.2 ,
and 21.5 ,
and 21.6 , and 21.7 .

| Sec. 20. State Lottery Fund.
|
16 |
| (a) There is created in the State Treasury a special fund |
17 |
| to be
known as the "State Lottery Fund". Such fund shall |
18 |
| consist of all revenues
received from (1) the sale of lottery |
19 |
| tickets or shares, (net of
commissions, fees
representing those |
20 |
| expenses that are directly proportionate to the
sale of tickets |
21 |
| or shares at the agent location, and prizes of less
than
$600 |
22 |
| which
have been validly paid at the agent
level), (2) |
23 |
| application fees,
and (3) all other sources including moneys |
24 |
| credited or transferred thereto
from
any other fund
or source |
25 |
| pursuant to law. Interest earnings of the State Lottery Fund
|
26 |
| shall be credited to the Common School Fund.
|
27 |
| (b) The receipt and distribution of moneys under Section |
28 |
| 21.5 of this Act shall be in accordance with Section 21.5.
|

(b) The receipt and distribution of moneys under |

| Section 21.6 of this Act shall be in accordance with Section |
31 |
| 21.6. |

| (d) The receipt and distribution of moneys under Section |

| 21.7 of this Act shall be in accordance with Section 21.7.

| Sec. 21.7. Wild about animals scratch-off game. |
7 |
| (a) The Department shall offer a special instant |
8 |
| scratch-off game for the benefit of threatened or endangered |
9 |
| species, humane education programs, and dogs and cats. The game |
10 |
| shall commence on January 1, 2007 or as soon thereafter, in the |
11 |
| discretion of the Director, as is reasonably practical. The |
12 |
| operation of the game shall be governed by this Act and any |
13 |
| rules adopted by the Department. If any provision of this |
14 |
| Section is inconsistent with any other provision of this Act, |
15 |
| then this Section governs.

| (b) The Endangered Species Rehabilitation Fund is created |
17 |
| as a special fund in the State treasury. The net revenue from |
18 |
| the wild about animals scratch-off game created under this |
19 |
| Section shall be deposited into the Fund for appropriation by |
20 |
| the General Assembly as follows: |
21 |
| (1) One-third of net revenue to the Department of |
22 |
| Natural Resources for making grants for the maintenance of |
23 |
| wildlife rehabilitation facilities that take care of |
24 |
| threatened or endangered species. |
25 |
| (2) One-third of net revenue to the State Board of |
26 |
| Education for character and humane education programs; and |
27 |
| (3) One-third of net revenue into the Pet Population |
28 |
| Control Fund. |
29 |
| Moneys received for the purposes of this Section, |
30 |
| including, without limitation, net revenue from the special |
31 |
| instant scratch-off game and from gifts, grants, and awards |
32 |
| from any public or private entity, must be deposited into the |
33 |
| Fund. Any interest earned on moneys in the Fund must be |
34 |
| deposited into the Fund. For purposes of this subsection, "net |
35 |
| revenue" means the total amount for which tickets have been |

| sold less the sum of the amount paid out in the prizes and the |
2 |
| actual administrative expenses of the Department solely |
3 |
| related to the scratch-off game under this Section. |

| (c) During the time that tickets are sold for the wild |
5 |
| about animals scratch-off game, the Department shall not |
6 |
| unreasonably diminish the efforts devoted to marketing any |
7 |
| other instant scratch-off lottery game. |
8 |
| (d) The Department may adopt any rules necessary to |
9 |
| implement and administer the provisions of this Section. |
10 |
| Section 10. The State Finance Act is amended by adding |
11 |
| Section
5.663 as follows: |

| Sec. 5.663. The Endangered Species Rehabilitation Fund.

| Section 99. Effective date. This Act takes effect upon |
15 |
| becoming law.
