SYNOPSIS AS INTRODUCED:

    Amends the Illinois Lottery Law. Requires the Department of Revenue to offer a special instant scratch-off game for the benefit of endangered species, to commence on January 1, 2007. Provides that the net revenue from the game shall be deposited into the Endangered Species Rehabilitation Fund for appropriation by the General Assembly solely to the Department of Natural Resources for making grants for the maintenance of wildlife rehabilitation facilities that take care of threatened or endangered species. Sets forth certain provisions for the operation of the scratch-off game. Amends the State Finance Act to create the Endangered Species Rehabilitation Fund. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Lottery Law is amended by changing
5 Sections 2 and 20 and by adding Section 21.7 as follows:

7     Sec. 2. This Act is enacted to implement and establish
8 within the State a lottery to be operated by the State, the
9 entire net proceeds of which are to be used for the support of
10 the State's Common School Fund, except as provided in Sections
11 21.2, and 21.5, and 21.6 , and 21.7.

15     Sec. 20. State Lottery Fund.
16     (a) There is created in the State Treasury a special fund
17 to be known as the "State Lottery Fund". Such fund shall
18 consist of all revenues received from (1) the sale of lottery
19 tickets or shares, (net of commissions, fees representing those
20 expenses that are directly proportionate to the sale of tickets
21 or shares at the agent location, and prizes of less than $600
22 which have been validly paid at the agent level), (2)
23 application fees, and (3) all other sources including moneys
24 credited or transferred thereto from any other fund or source
25 pursuant to law. Interest earnings of the State Lottery Fund
26 shall be credited to the Common School Fund.
27     (b) The receipt and distribution of moneys under Section
28 21.5 of this Act shall be in accordance with Section 21.5.
29     (c) (b) The receipt and distribution of moneys under
30 Section 21.6 of this Act shall be in accordance with Section
31 21.6.

1     (d) The receipt and distribution of moneys under Section
2 21.7 of this Act shall be in accordance with Section 21.7.

6     Sec. 21.7. Endangered species scratch-off game.
7     (a) The Department shall offer a special instant
8 scratch-off game for the benefit of threatened or endangered
9 species. The game shall commence on January 1, 2007 or as soon
10 thereafter, in the discretion of the Director, as is reasonably
11 practical. The operation of the game shall be governed by this
12 Act and any rules adopted by the Department. If any provision
13 of this Section is inconsistent with any other provision of
14 this Act, then this Section governs.
15     (b) The Endangered Species Rehabilitation Fund is created
16 as a special fund in the State treasury. The net revenue from
17 the endangered species scratch-off game created under this
18 Section shall be deposited into the Fund for appropriation by
19 the General Assembly solely to the Department of Natural
20 Resources for making grants for the maintenance of wildlife
21 rehabilitation facilities that take care of threatened or
22 endangered species.
23     Moneys received for the purposes of this Section,
24 including, without limitation, net revenue from the special
25 instant scratch-off game and from gifts, grants, and awards
26 from any public or private entity, must be deposited into the
27 Fund. Any interest earned on moneys in the Fund must be
28 deposited into the Fund. For purposes of this subsection, "net
29 revenue" means the total amount for which tickets have been
30 sold less the sum of the amount paid out in the prizes and the
31 actual administrative expenses of the Department solely
32 related to the scratch-off game under this Section.
33     (c) During the time that tickets are sold for the
34 endangered species scratch-off game, the Department shall not
35 unreasonably diminish the efforts devoted to marketing any

1 other instant scratch-off lottery game.
2     (d) The Department may adopt any rules necessary to
3 implement and administer the provisions of this Section.
 
4     Section 10. The State Finance Act is amended by adding
5 Section 5.663 as follows:
 
6     (30 ILCS 105/5.663 new)
7     Sec. 5.663. The Endangered Species Rehabilitation Fund.
 
8     Section 99. Effective date. This Act takes effect upon
9 becoming law.
