| AMENDMENT NO. ______. Amend House Bill 4298, AS AMENDED, by |

| replacing everything after the enacting clause with the |
4 |
| following:
|

| "Section 1. Short title. This Act may be cited as the |
6 |
| Interstate Sex Offender Task Force Act.
|
7 |
| Section 5. Findings. The General Assembly finds as follows: |
8 |
| (1) That the protection of women and children from sexual |
9 |
| assault is critically important. |
10 |
| (2) That every state in the nation has a sex offender |
11 |
| registration law.
|
12 |
| (3) That Illinois, as well as other states in the nation, |
13 |
| including Iowa and Missouri, have laws restricting where |
14 |
| convicted or registered sex offenders may reside. |
15 |
| (4) That the residency restrictions are not consistent |
16 |
| between states. |
17 |
| (5) That the disparity in residency restrictions and |
18 |
| registration requirements is of concern to communities and law |
19 |
| enforcement in Illinois. |
20 |
| (6) That it would benefit Illinois, its citizens, and its |
21 |
| border states, including Iowa and Missouri, for a task force to |
22 |
| be created to analyze the impact of the disparity between |
23 |
| states regarding registration requirements and residency |
24 |
| restrictions on convicted or registered sex offenders, or both.

| Section 10. Interstate Sex Offender Task Force. |

| (a) The Interstate Sex Offender Task Force is created. |
3 |
| (b) The Interstate Sex Offender Task Force shall convene |
4 |
| and initially meet not later than 30 days after the effective |
5 |
| date of this Act and shall meet thereafter as frequently as |
6 |
| necessary to carry out its duties as required by this Act. |
7 |
| (c) The Task Force shall consist of the Director of the |
8 |
| Illinois Department of Corrections (or the Director's |
9 |
| designee) who shall act as the Chair of the Task Force, the |
10 |
| Director of the Illinois Department of State Police (or the |
11 |
| Director's designee), the Attorney General (or the Attorney |
12 |
| General's designee), one member of the General Assembly |
13 |
| appointed by each of the following: the President of the |
14 |
| Senate, the Minority Leader of the Senate, the Speaker of the |
15 |
| House of Representatives, and the Minority Leader of the House |
16 |
| of Representatives; together with one member designated by the |
17 |
| Illinois State's Attorneys Association, one member designated |
18 |
| by the Illinois Association of the Chiefs of Police, one member |
19 |
| designated by the Illinois Sheriffs' Association, and any |
20 |
| additional members the Chair of the Task Force may designate. |
21 |
| (d) The Task Force shall coordinate its meetings and |
22 |
| studies with such representatives of similar organizations in |
23 |
| the other states as may be appropriate, including but not |
24 |
| limited to those in Iowa, Wisconsin, Indiana, Kentucky, and |
25 |
| Missouri. Members of the Task Force shall serve without |
26 |
| compensation, but may be reimbursed for actual expenses as the |
27 |
| discretion of the Director of the Illinois Department of |
28 |
| Corrections from funds appropriated for that purpose. |
29 |
| (e) The Task Force shall examine the following: |
30 |
| (1) The systems of communication between states |
31 |
| regarding the interstate movement of registered sex |
32 |
| offenders.
|

| (2) The laws of Illinois and its border states that |

| restrict and affect where convicted or registered sex |
2 |
| offenders may reside.
|
3 |
| (3) The extent to which law enforcement resources are |
4 |
| affected by residency restrictions.
|
5 |
| (4) The impact of residency restrictions on the parole, |
6 |
| mandatory supervised release, and probation systems in |
7 |
| Illinois. |
8 |
| (f) The Illinois Department of Corrections shall provide |
9 |
| staff and administrative support services to the Task Force. |
10 |
| (g) The Task Force shall report its findings and |
11 |
| recommendations to the Governor, the Attorney General, and the |
12 |
| General Assembly no later than January 1, 2008.

| Section 99. Effective date. This Act takes effect upon |
14 |
| becoming law.".
