| AN ACT concerning law enforcement.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Police Training Act is amended by |
5 |
| adding Section 10.4 as follows: |
6 |
| (50 ILCS 705/10.4 new) |
7 |
| Sec. 10.4. Weapon certification for retired law |
8 |
| enforcement officers. The Board may initiate, administer, and |
9 |
| conduct annual firearm certification courses consistent with |
10 |
| the requirements enumerated in the Peace Officer Firearm |
11 |
| Training Act for retired law enforcement officers qualified |
12 |
| under federal law to carry a concealed weapon. |
13 |
| Section 10. The Peace Officer Firearm Training Act is |
14 |
| amended by changing Section 1 and by adding Section 2.5 as |
15 |
| follows:

| Sec. 1. Definitions. As used in this Act: (a) "Peace |
18 |
| officer"
means (i) any person who by virtue of his office or |
19 |
| public employment is
vested by law with a primary duty to |
20 |
| maintain public order or to make
arrests for offenses, whether |
21 |
| that duty extends to all offenses or is
limited to specific |
22 |
| offenses, and who is employed in such capacity by any
county or |
23 |
| municipality or (ii) any retired law enforcement officers |
24 |
| qualified under federal law to carry a concealed weapon . (b)
|
25 |
| "Firearms" means any weapon or device defined as a firearm in |
26 |
| Section
1.1 of "An Act relating to the acquisition, possession |
27 |
| and transfer of
firearms and firearm ammunition, to provide a |
28 |
| penalty for the violation
thereof and to make an appropriation |
29 |
| in connection therewith", approved
August 3, 1967, as amended.

| Sec. 2. Definitions. |

| "Board" means the Illinois Law Enforcement Training
|
12 |
| Standards Board created by the Illinois Police Training Act.
|
13 |
| "Director" means the Executive Director of the Board.
|
14 |
| "Chairman" means the Chairman of the Board.
|
15 |
| "Appointed Member" means a member of the Board appointed by |
16 |
| the Governor
pursuant to the Illinois Police Training Act and |
17 |
| designated by the Director
to serve on an Advisory Board.

18 |
| "Mobile Team In-Service Training Unit" or "Mobile Team" |
19 |
| means
an organization formed by a combination of units of local |
20 |
| government and the
Board and established under this Act to |
21 |
| deliver in-service training at scheduled times and selected |
22 |
| sites within a geographic region to (i) local
and State law |
23 |
| enforcement officers (whether employed on a full-time or
|
24 |
| part-time basis) and (ii) retired law enforcement officers |
25 |
| qualified under federal law to carry a concealed weapon
at |
26 |
| scheduled times and selected sites within a
geographic region .
|
27 |
| "Advisory Board" means a Board composed of a representative |
28 |
| number of county
board members, mayors, chiefs of police, and |
29 |
| sheriffs of participating units of
local government, and the |
30 |
| Director, Chairman or appointed member of the
Illinois Law |
31 |
| Enforcement Training Standards Board. The composition and |
32 |
| number
of each Advisory Board will be determined by the |
33 |
| participants. Members of the
Advisory Board shall serve without |

| compensation but may be reimbursed for
reasonable expenses |

| incurred in carrying out their duties.
|

| "Unit of local government" means a unit of local government |
4 |
| as
defined in Article VII, Section 1 of the Illinois |
5 |
| Constitution of 1970 and
includes both home rule units and |
6 |
| units which are not home rule units.
|

| Sec. 4. State Funding-Minimum Criteria. A Mobile Team |

| In-Service Training
Unit which meets the minimum criteria |

| established in this Section is eligible
to receive State funds |
12 |
| to help defray the costs of operation. To be eligible
a Mobile |
13 |
| Team must:
|
14 |
| (1) Be established and operating pursuant to the |
15 |
| Intergovernmental
Cooperation
Section Article VII, Section 10, |
16 |
| of the Illinois Constitution of 1970 and
must involve two or |
17 |
| more units of local government including at least one
county |
18 |
| and the Board.
|
19 |
| (2) Establish an Advisory Board composed of elected local |
20 |
| officials and
chief law enforcement officers from |
21 |
| participating units of local government and
the Director, |
22 |
| Chairman or appointed member of the Board to
oversee the |
23 |
| operations of the Mobile Team and make such reports to the |
24 |
| Board
as the Board may require.
|
25 |
| (3) Designate an elected local official to act as the |
26 |
| financial officer
of the Mobile Team for all participating |
27 |
| units of government, and to receive
and expend funds for the |
28 |
| operation of the Mobile Team.
|
29 |
| (4) Limit its operations to in-service training of law |
30 |
| enforcement personnel
employed by the State, by units of local |
31 |
| government or by the Federal government or
their agencies and |
32 |
| departments in the administration of justice or retired law |
33 |
| enforcement officers qualified under federal law to carry a |
34 |
| concealed weapon .

35 |
| (5) Cooperate with the Board in order to assure compliance |
