Amends the Children and Family Services Act, the Department of State Police Law of the Civil Administrative Code of Illinois, and the School Code. Requires DCFS, the Department of State Police, and the State Board of Education to jointly develop a sample protocol for handling situations involving (i) the arrest of a person or persons for the manufacture of methamphetamine at a place where a child resides or (ii) a child's exposure to an environment in which methamphetamine is manufactured or used. Requires that the protocol be developed within one year. Requires that the protocol be posted on the Web sites maintained by DCFS, the Department of State Police, and the State Board of Education.

| AN ACT concerning children.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|
4 |
| Section 5. The Children and Family Services Act is amended |
5 |
| by adding Section 6.5 as follows: |

| (20 ILCS 505/6.5 new) |
7 |
| Sec. 6.5. Children; methamphetamine; protocol. |
8 |
| (a) The Department of Children and Family Services, the |
9 |
| Department of State Police, and the State Board of Education |
10 |
| shall jointly develop a sample protocol to be followed by the |
11 |
| Department of Children and Family Services, the Department of |
12 |
| State Police or a local law enforcement agency, or a school |
13 |
| when: |
14 |
| (1) a person or persons are arrested for manufacturing |
15 |
| methamphetamine at a place where a child under 18 years of |
16 |
| age resides; or |
17 |
| (2) the Department of Children and Family Services, the |
18 |
| Department of State Police or a local law enforcement |
19 |
| agency, or a school has reason to believe that a child |
20 |
| under 18 years of age is being exposed to an environment |
21 |
| where methamphetamine is manufactured or used. |

| (b) At a minimum, the protocol developed under this Section |
23 |
| must do the following: |
24 |
| (1) Provide for an appropriate custodian of the |
25 |
| affected child. |
26 |
| (2) Provide for the necessary care and supervision of |
27 |
| the affected child, including appropriate shelter, |
28 |
| clothing, food, and medical care. |
29 |
| (3) Provide for the child's attendance at an |
30 |
| appropriate school. |

| (c) The Department of Children and Family Services, the |
32 |
| Department of State Police, and the State Board of Education |
