AMENDMENT TO HOUSE BILL 3125

2     AMENDMENT NO. ______. Amend House Bill 3125 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Vehicle Code is amended by adding
5 Section 3-600.1 as follows:
 
6     (625 ILCS 5/3-600.1 new)
7     Sec. 3-600.1. The Citizens' Special License Plate
8 Commission.
9     (a) The General Assembly finds that any special or
10 temporary motor vehicle license plate, logo, or motto is a
11 reflection of the official views of the people of the State of
12 Illinois. It is the intent of the General Assembly that the
13 selection and approval of special motor vehicle license plates,
14 logos, and mottos must be separated from politics to the
15 maximum extent practicable.
16     (b) There is created a Citizens' Nonpartisan Special
17 Vehicle License Plates Commission consisting of 6 members
18 appointed as follows: 3 members appointed by the Secretary of
19 State from members of his or her own political party, and 3
20 members appointed by the Secretary of State from members of the
21 political party whose candidate received the second largest
22 number of votes at the immediately preceding election for
23 Secretary of State.
24     (c) The Commission shall elect its own chairman. The

1 chairman of the Commission shall have the right to ask for
2 staff support from the Office of the Secretary of State as
3 necessary to enable the Commission to carry out its official
4 duties. The Commission shall not be empowered to appoint an
5 executive director or to hire any independent staff of its own.
6 The Commission shall meet at the call of the chair, but in no
7 case less than once every calendar quarter. Commission members
8 shall receive no pay but their legitimate expenses.
9     (d) The Commission at its meetings shall take up as part of
10 its agenda recommendations on all special and temporary license
11 plate applications received by the Secretary of State in a
12 timely manner. The Commission shall vote on each application
13 separately, and 4 votes, or a two-thirds majority of the full
14 Commission, shall be required for the Commission to make a
15 formal recommendation to the Secretary of State to approve or
16 disapprove an application for the issuance of special license
17 plates.
18     (e) The initial appointment of members of the Commission
19 shall be for staggered terms, with one member of the
20 Secretary's party and one member of the party whose candidate
21 for Secretary of State received the second largest number of
22 votes at the immediately preceding election for Secretary of
23 State each being appointed to 2-year terms, one member of each
24 of the 2 parties being appointed to 3-year terms, and one
25 member of each of the 2 parties being appointed to 4-year
26 terms. All subsequent terms shall be 4 years in length. The
27 Secretary of State shall have the power to fill all vacant
28 terms and shall fill any vacancies as soon as possible.
29     (f) The Commission shall be an advisory panel and its
30 operations shall not interfere with the ultimate authority of
31 the Secretary of State to make decisions regarding special
32 plates.".
