    Amends the Developmental Disability and Mental Disability Services Act. Makes a technical change in a Section concerning an application and the amount of services to be provided.

1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Developmental Disability and Mental
5 Disability Services Act is amended by changing Section 2-6 as
6 follows:
 
7     (405 ILCS 80/2-6)  (from Ch. 91 1/2, par. 1802-6)
8     Sec. 2-6. An application for the the Program shall be
9 submitted to the Department by the mentally disabled adult or,
10 if the mentally disabled adult requires a guardian, by his or
11 her legal guardian. If the application for participation in the
12 Program is approved by the Department and the mentally disabled
13 adult is eligible to receive services under this Article, the
14 mentally disabled adult shall be made aware of the availability
15 of a community support team and shall be offered case
16 management services. The amount of the home-based services
17 provided by the Department in any month shall be determined by
18 the service plan of the mentally disabled adult, but in no case
19 shall it be more than either:
20         (a) three hundred percent of the monthly federal
21     Supplemental Security Income payment for an individual
22     residing alone if the mentally disabled adult is not
23     enrolled in a special education program by a local
24     education agency, or
25         (b) two hundred percent of the monthly Supplemental
26     Security Income payment for an individual residing alone if
27     the mentally disabled adult is enrolled in a special
28     education program by a local education agency.
29     Upon approval of the Department, all or part of the monthly
30 amount approved for home-based services to participating
31 adults may be used as a one-time or continuing payment to the
32 eligible adult or the adult's parent or guardian to pay for

1 specified tangible items that are directly related to meeting
2 basic needs related to the person's mental disabilities.
3     Tangible items include, but are not limited to: adaptive
4 equipment, medication not covered by third-party payments,
5 nutritional supplements, and residential modifications.
