Amends the Illinois Food, Drug, and Cosmetic Act. Provides that whoever uses human growth hormone in connection with his or her participation in professional or amateur sporting activities, is guilty of a Class 3 felony, and may be fined an amount not to exceed $50,000. Effective immediately.

| AN ACT concerning health.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Food, Drug and Cosmetic Act is |
5 |
| amended by changing Section 3.22 as follows:
|

| (410 ILCS 620/3.22) (from Ch. 56 1/2, par. 503.22)

| Sec. 3.22. Human growth hormone; distribution and use.
|
8 |
| (a) Whoever knowingly distributes, or possesses with |
9 |
| intent to
distribute, human growth hormone for any use in |
10 |
| humans other than the
treatment of a disease or other |
11 |
| recognized medical condition, where the use
has been authorized |
12 |
| by the Secretary of Health and Human Services and under
the |
13 |
| order of a physician, is guilty of a Class 3 felony, and may be |
14 |
| fined
an amount not to exceed $50,000.
|

| (b) Whoever knowingly uses human growth hormone in |
16 |
| connection with his or her participation in professional or |
17 |
| amateur sporting activities, is guilty of a Class 3 felony, and |
18 |
| may be fined an amount not to exceed $50,000.
|
19 |
| (c) Whoever commits any offense set forth in subsection (a) |
20 |
| of this Section and the offense
involves an individual under 18 |
21 |
| years of age is punishable by not more than
10 years |
22 |
| imprisonment, and twice the fine authorized above. Any |
23 |
| conviction
for a violation of this Section shall be considered |
24 |
| a violation of the
Illinois Controlled Substances Act for the |
25 |
| purposes of forfeiture under
Section 505 of such Act. As used |
26 |
| in this Section the term "human growth
hormone" means somatrem, |
27 |
| somatropin, or an analogue of either of them. The
Department of |
28 |
| State Police and Department of Professional Regulation are
|
29 |
| authorized to investigate offenses punishable by this Section.

| Section 99. Effective date. This Act takes effect upon |

| becoming law.
