| AN ACT concerning State government.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Act on the Aging is amended by |
5 |
| adding Section 4.02e as follows: |
6 |
| (20 ILCS 105/4.02e new)
|
7 |
| Sec. 4.02e. Adult day service program certification. For |
8 |
| the purpose of long term care insurance payouts to clients of |
9 |
| the Department's program of services to prevent unnecessary |
10 |
| institutionalization established in Section 4.02 of this Act, a |
11 |
| contract with the Department for the procurement of adult day |
12 |
| service shall constitute certification by the Department of the |
13 |
| adult day service. For the purposes of this Section, "adult day |
14 |
| service" means the direct care and supervision of adults aged |
15 |
| 60 and over in a community-based setting for the purpose of |
16 |
| providing personal attention and promoting social, physical, |
17 |
| and emotional well-being in a structured setting.

| Section 99. Effective date. This Act takes effect July 1, |
19 |
| 2005.
