SYNOPSIS AS INTRODUCED:
 
815 ILCS 370/4.1   from Ch. 5, par. 1704.1

    Amends the Motor Fuel and Petroleum Standards Act. Provides that, beginning January 1, 2008, all gasoline sold or offered for sale at retail in this State for use in cars or trucks upon the highways of this State must contain at least 10% ethanol, and beginning January 1, 2012, all such gasoline must contain at least 15% ethanol.

1     AN ACT concerning motor fuel.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Motor Fuel and Petroleum Standards Act is
5 amended by changing Section 4.1 as follows:
 
6     (815 ILCS 370/4.1)  (from Ch. 5, par. 1704.1)
7     Sec. 4.1. Ethanol; MTBE (a) Upon any retail motor fuel
8 dispensing device which is used to dispense a motor fuel
9 containing at least 1% by volume of ethanol, of methanol, or of
10 a combination thereof, there shall be displayed a label which
11 identifies the maximum percentage by volume, to the nearest
12 whole percent, of ethanol, of methanol, and of co-solvent
13 contained in the motor fuel. Such labelling shall be done in
14 contrasting colors with block letters at least 1/2 inch in
15 height and 1/4 inch in width, and not more than one inch in
16 height and 1/2 inch in width, and shall be visible to
17 customers. The label shall be located on the front or sides of
18 the dispenser and within the top 30 percent of the height of
19 the dispenser. On a dual-faced dispenser, the label shall be
20 affixed on each front or each side in accordance with these
21 requirements. Devices used to dispense only motor fuels which
22 contain a total of less than 1% by volume of methanol and
23 ethanol need not be so labelled.
24     (a-5) Upon any retail motor fuel dispensing device that is
25 used to dispense a motor fuel containing at least 2% by volume
26 of the methanol derivative methyl tertiary butyl ether (MTBE),
27 there shall be displayed a label stating: "CONTAINS METHYL
28 TERTIARY BUTYL ETHER (MTBE)". The label shall be done in
29 contrasting colors with block letters at least 1/2 inch in
30 height and 1/4 inch in width, and not more than one inch in
31 height and 1/2 inch in width, and shall be visible to
32 customers. The label shall be located on the front or sides of

1 the dispenser and within the top 30 percent of the height of
2 the dispenser. On a dual-faced dispenser, the label shall be
3 affixed on each front or each side in accordance with these
4 requirements. Devices used to dispense only motor fuels that
5 contain a total of less than 2% by volume of the methanol
6 derivative MTBE need not be so labeled.
7     (b) Each seller of a motor fuel which contains methanol,
8 ethanol, or the methanol derivative MTBE shall notify the
9 purchaser thereof of the percentage by volume of ethanol, of
10 methanol, of the methanol derivative MTBE, and of co-solvent
11 which have been added to such motor fuel, and this information
12 shall appear on the bill of lading, manifest or delivery ticket
13 for such motor fuel. However, this subsection (b) shall not
14 apply to sales at retail.
15     (c) No motor fuel, whether or not it contains any lead or
16 lead compounds, may contain more ethanol, methanol, or the
17 methanol derivative MTBE than is permitted, or contain less
18 co-solvent than is required, by the United States Environmental
19 Protection Agency for unleaded motor fuels under Section 211(f)
20 of the federal Clean Air Act.
21     (d) All motor fuel sold or offered for sale by the
22 distributor shall contain the percentage and type of alcohol as
23 stated on the bill of lading, manifest or delivery ticket.
24     (e) With respect to the methanol derivative MTBE, the
25 labeling and notification requirements in this Section shall be
26 enforced beginning 60 days after the effective date of this
27 amendatory Act of the 91st General Assembly.
28     (f) Nothing in this Section shall be construed to require
29 or impose an obligation upon the owner or operator of a retail
30 motor fuel dispensing station, facility, or device to perform a
31 test on or measurement of a shipment of motor fuel received to
32 determine the specific content of ethanol, methanol, or the
33 methanol derivative MTBE.
34     (g) Beginning January 1, 2008, all gasoline sold or offered
35 for sale at retail in this State for use in cars or trucks upon
36 the highways of this State must contain at least 10% ethanol,

1 and beginning January 1, 2012, all such gasoline must contain
2 at least 15% ethanol.
