1 | AN ACT concerning transportation.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Vehicle Code is amended by changing | ||||||
5 | Sections 3-412 and 12-503 and adding Section 3-663 as follows:
| ||||||
6 | (625 ILCS 5/3-412) (from Ch. 95 1/2, par. 3-412)
| ||||||
7 | Sec. 3-412. Registration plates and registration stickers | ||||||
8 | to be
furnished by the Secretary of State.
| ||||||
9 | (a) The Secretary of State upon registering a vehicle | ||||||
10 | subject to annual
registration for the first time shall issue | ||||||
11 | or shall cause to be issued to the
owner one registration plate | ||||||
12 | for a motorcycle, trailer, semitrailer, motorized
pedalcycle | ||||||
13 | or truck-tractor, 2 registration plates for other motor | ||||||
14 | vehicles
and, where applicable, current registration stickers | ||||||
15 | for motor vehicles of the
first division. The provisions of | ||||||
16 | this Section may be made applicable to such
vehicles of the | ||||||
17 | second division, as the Secretary of State may, from time to
| ||||||
18 | time, in his discretion designate. On subsequent annual | ||||||
19 | registrations
during the term of the registration plate as | ||||||
20 | provided in Section 3-414.1, the
Secretary shall issue or cause | ||||||
21 | to be issued registration stickers as evidence
of current | ||||||
22 | registration. However, the issuance of annual registration | ||||||
23 | stickers
to vehicles registered under the provisions of | ||||||
24 | Sections 3-402.1 and 3-405.3 of
this Code may not be required | ||||||
25 | if the Secretary deems the issuance unnecessary.
| ||||||
26 | (b) Every registration plate shall have displayed upon it | ||||||
27 | the registration
number assigned to the vehicle for which it is | ||||||
28 | issued, the name of this State,
which may be abbreviated, the | ||||||
29 | year number for which it was issued, which may
be abbreviated, | ||||||
30 | the phrase "Land of Lincoln" (except as otherwise provided in
| ||||||
31 | this Code Chapter 3 ), and such other letters or numbers as the | ||||||
32 | Secretary
may prescribe. However, for apportionment plates |
| |||||||
| |||||||
1 | issued to vehicles registered
under Section 3-402.1 and fleet | ||||||
2 | plates issued to vehicles registered under
Section 3-405.3, the | ||||||
3 | phrase "Land of Lincoln" may be omitted to allow for
the word | ||||||
4 | "apportioned", the word "fleet", or other similar language to | ||||||
5 | be
displayed. Registration plates issued to a vehicle | ||||||
6 | registered as a fleet
vehicle may display a designation | ||||||
7 | determined by the Secretary.
| ||||||
8 | The Secretary may in his discretion prescribe
that letters | ||||||
9 | be used as prefixes only on registration plates issued to | ||||||
10 | vehicles
of the first division which are registered under this | ||||||
11 | Code and only as suffixes
on registration plates issued to | ||||||
12 | other vehicles. Every registration sticker
issued as evidence | ||||||
13 | of current registration shall designate the year number
for | ||||||
14 | which it is issued and such other letters or numbers as the | ||||||
15 | Secretary may
prescribe and shall be of a contrasting color | ||||||
16 | with the registration plates and
registration stickers of the | ||||||
17 | previous year.
| ||||||
18 | (c) Each registration plate and the required letters and | ||||||
19 | numerals thereon,
except the year number for which issued, | ||||||
20 | shall be of sufficient size to be
plainly readable from a | ||||||
21 | distance of 100 feet during daylight, and shall be
coated with | ||||||
22 | reflectorizing material. The dimensions of the plate issued to
| ||||||
23 | vehicles of the first division shall be 6 by 12 inches.
| ||||||
24 | (d) The Secretary of State shall issue for every passenger | ||||||
25 | motor vehicle
rented without a driver the same type of | ||||||
26 | registration plates as the type of
plates issued for a private | ||||||
27 | passenger vehicle.
| ||||||
28 | (e) The Secretary of State shall issue for every passenger
| ||||||
29 | car used as a taxicab or livery, distinctive registration | ||||||
30 | plates.
| ||||||
31 | (f) The Secretary of State shall issue for every motorcycle
| ||||||
32 | distinctive registration plates distinguishing between
| ||||||
33 | motorcycles having 150 or more cubic centimeters piston
| ||||||
34 | displacement, or having less than 150 cubic centimeter
piston | ||||||
35 | displacement.
| ||||||
36 | (g) Registration plates issued to vehicles for-hire may
|
| |||||||
| |||||||
1 | display a designation as determined by the Secretary that
such | ||||||
2 | vehicles are for-hire.
| ||||||
3 | (h) The Secretary of State shall issue for each electric
| ||||||
4 | vehicle distinctive registration plates which shall | ||||||
5 | distinguish
between electric vehicles having a maximum | ||||||
6 | operating speed
of 45 miles per hour or more and those having a | ||||||
7 | maximum
operating speed of less than 45 miles per hour.
| ||||||
8 | (i) The Secretary of State shall issue for every public and | ||||||
9 | private
ambulance registration plates identifying the vehicle | ||||||
10 | as an ambulance.
The Secretary shall forward to the Department | ||||||
11 | of Public Aid registration
information for the purpose of | ||||||
12 | verification of claims filed with the
Department by ambulance | ||||||
13 | owners for payment for services to public assistance
| ||||||
14 | recipients.
| ||||||
15 | (j) The Secretary of State shall issue for every public and | ||||||
16 | private
medical carrier or rescue vehicle livery registration | ||||||
17 | plates displaying
numbers within ranges of numbers reserved | ||||||
18 | respectively for medical carriers
and rescue vehicles. The | ||||||
19 | Secretary shall forward to the Department of Public
Aid | ||||||
20 | registration information for the purpose of verification of | ||||||
21 | claims filed
with the Department by owners of medical carriers | ||||||
22 | or rescue vehicles for
payment for services to public | ||||||
23 | assistance recipients.
| ||||||
24 | (k) The Secretary of State shall issue distinctive license | ||||||
25 | plates for every vehicle exempted from subsection (a) of | ||||||
26 | Section 12-503 by subsection (g-5) of that Section.

29 | (625 ILCS 5/3-663 new) | ||||||
30 | Sec. 3-663. Medically Required Tinted Window plates. The | ||||||
31 | Secretary, upon receipt of an application made in the form | ||||||
32 | prescribed by the Secretary, may issue special registration | ||||||
33 | plates designated as Medically Required Tinted Window license | ||||||
34 | plates. The special plates issued under this Section shall be | ||||||
35 | affixed only to passenger vehicles of the first division and |

| |||||||
1 | motor vehicles of the second division weighing not more than | ||||||
2 | 8,000 pounds. Plates issued under this Section shall expire | ||||||
3 | according to the multi-year procedure established by Section | ||||||
4 | 3-414.1 of this Code. The design and color of the plates shall | ||||||
5 | be wholly within the discretion of the Secretary of State.

| ||||||
7 | Sec. 12-503. Windshields must be unobstructed and equipped | ||||||
8 | with wipers.
| ||||||
9 | (a) No person shall drive a motor vehicle with any sign, | ||||||
10 | poster, window
application, reflective material, nonreflective | ||||||
11 | material or tinted film
upon the front windshield, sidewings or | ||||||
12 | side windows immediately adjacent
to each side of the driver. A | ||||||
13 | nonreflective tinted film may be used along
the uppermost | ||||||
14 | portion of the windshield if such material does not extend
more | ||||||
15 | than 6 inches down from the top of the windshield. Nothing in | ||||||
16 | this
Section shall create a cause of action on behalf of a | ||||||
17 | buyer against a
dealer or manufacturer who sells a motor | ||||||
18 | vehicle with a window which is in
violation of this Section.
| ||||||
19 | (b) Nothing contained in this Section shall prohibit the | ||||||
20 | use of
nonreflective, smoked or tinted glass, nonreflective | ||||||
21 | film, perforated
window screen or other decorative window | ||||||
22 | application on windows to the rear
of the driver's seat, except | ||||||
23 | that any motor vehicle with a window to the
rear of the | ||||||
24 | driver's seat treated in this manner shall be equipped with a
| ||||||
25 | side mirror on each side of the motor vehicle which are in | ||||||
26 | conformance with
Section 12-502.
| ||||||
27 | (c) No person shall drive a motor vehicle with any objects | ||||||
28 | placed or
suspended between the driver and the front | ||||||
29 | windshield, rear
window, side wings or side windows immediately | ||||||
30 | adjacent to each side of
the driver which materially obstructs | ||||||
31 | the driver's view.
| ||||||
32 | (d) Every motor vehicle, except motorcycles, shall be | ||||||
33 | equipped with a
device, controlled by the driver, for cleaning | ||||||
34 | rain, snow, moisture or other
obstructions from the windshield; | ||||||
35 | and no person shall drive a motor vehicle
with snow, ice, |

| |||||||
1 | moisture or other material on any of the windows or
mirrors, | ||||||
2 | which materially obstructs the driver's clear view of the | ||||||
3 | highway.
| ||||||
4 | (e) No person shall drive a motor vehicle when the | ||||||
5 | windshield, side or
rear windows are in such defective | ||||||
6 | condition or repair as to materially
impair the driver's view | ||||||
7 | to the front, side or rear. A vehicle equipped
with a side | ||||||
8 | mirror on each side of the vehicle which are in conformance
| ||||||
9 | with Section 12-502 will be deemed to be in compliance in the | ||||||
10 | event the
rear window of the vehicle is materially obscured.
| ||||||
11 | (f) Paragraphs (a) and (b) of this Section shall not apply | ||||||
12 | to:
| ||||||
13 | (1) motor vehicles manufactured prior to January 1, | ||||||
14 | 1982; or
| ||||||
15 | (2) to those motor vehicles properly registered in | ||||||
16 | another jurisdiction.
| ||||||
17 | (g) Paragraph (a) of this Section shall not apply to any | ||||||
18 | motor vehicle with
a window treatment, including but not | ||||||
19 | limited to a window application,
reflective material, | ||||||
20 | nonreflective material, or tinted film, applied or affixed
to | ||||||
21 | the motor vehicle for the purposes set forth in item (1) or (2) | ||||||
22 | before the
effective date of this amendatory Act of 1997 and:
| ||||||
23 | (1) that is owned and operated by a person afflicted | ||||||
24 | with or suffering
from a medical illness, ailment, or | ||||||
25 | disease which would require that person
to be shielded from | ||||||
26 | the direct rays of the sun; or
| ||||||
27 | (2) that is used in transporting a person when the | ||||||
28 | person
resides at
the same address as the registered owner | ||||||
29 | of the vehicle and the
person is
afflicted with or | ||||||
30 | suffering from a medical illness, ailment or disease
which | ||||||
31 | would require the person to be shielded from the direct | ||||||
32 | rays
of the
sun;
| ||||||
33 | It must be certified by a physician licensed to | ||||||
34 | practice medicine in
Illinois that such person owning and | ||||||
35 | operating or being transported in a motor
vehicle is | ||||||
36 | afflicted with or suffers from such illness, ailment, or |
| |||||||
| |||||||
1 | disease and
such certification must be carried in the motor | ||||||
2 | vehicle at all times. The
certification shall be legible | ||||||
3 | and shall contain the date of issuance, the
name, address | ||||||
4 | and signature of the attending physician, and the name, | ||||||
5 | address,
and medical condition of the person requiring | ||||||
6 | exemption. The information on
the certificate for a window | ||||||
7 | treatment applied or affixed before the effective
date of | ||||||
8 | this amendatory Act of 1997 must remain current and shall | ||||||
9 | be renewed
annually by the attending physician, but in no | ||||||
10 | event shall a
certificate issued for purposes of this | ||||||
11 | subsection be valid on or after
January 1, 2008. The person | ||||||
12 | shall also submit a copy of the certification to
the | ||||||
13 | Secretary of
State. The Secretary of State may forward | ||||||
14 | notice of certification to law
enforcement agencies.
| ||||||
15 | This subsection shall not be construed to authorize window | ||||||
16 | treatments
applied or affixed on or after the effective date of | ||||||
17 | this amendatory Act of
1997.
| ||||||
18 | The exemption provided by this subsection (g) shall not | ||||||
19 | apply to any motor
vehicle on and after January 1, 2008.
| ||||||
20 | This subsection (g) does not apply to the exemption set | ||||||
21 | forth in subsection (g-5).
| ||||||
22 | (g-5) Paragraph (a) of this Section does not apply to any | ||||||
23 | motor vehicle with a window treatment, including but not | ||||||
24 | limited to a window application, reflective material, | ||||||
25 | nonreflective material, or tinted film, applied or affixed to a | ||||||
26 | motor vehicle that: | ||||||
27 | (i) is owned and operated by a person afflicted with or | ||||||
28 | suffering from systemic or discoid lupus erythematosus; or | ||||||
29 | (ii) is used in transporting a person who resides at | ||||||
30 | the same address as the registered owner and is afflicted | ||||||
31 | with or suffers from systemic or discoid lupus | ||||||
32 | erythematosus. | ||||||
33 | It must be certified by a physician licensed to practice | ||||||
34 | medicine in Illinois that the person owning and operating or | ||||||
35 | being transported in a motor vehicle is afflicted with or | ||||||
36 | suffers from systemic or discoid lupus erythematosus and the |
| |||||||
| |||||||
1 | certification must be carried in the motor vehicle at all | ||||||
2 | times. The certification shall be legible and shall contain the | ||||||
3 | date of issuance, the name, address, and signature of the | ||||||
4 | attending physician, and the name, address, and medical | ||||||
5 | condition of the person requiring exemption. The information on | ||||||
6 | the certificate for a window treatment must remain current and | ||||||
7 | shall be renewed annually by the attending physician. The owner | ||||||
8 | of the vehicle shall also submit a copy of the certification to | ||||||
9 | the Secretary of State. The Secretary of State may forward | ||||||
10 | notice of certification to law enforcement agencies.
| ||||||
11 | (h) Paragraph (a) of this Section shall not apply to motor | ||||||
12 | vehicle
stickers or other certificates issued by State or local | ||||||
13 | authorities which
are required to be displayed upon motor | ||||||
14 | vehicle windows to evidence
compliance with requirements | ||||||
15 | concerning motor vehicles.
| ||||||
16 | (i) Those motor vehicles exempted under paragraph (f)(1) of | ||||||
17 | this Section
shall not cause their windows to be treated as | ||||||
18 | described in paragraph (a) after
January 1, 1993.
| ||||||
19 | (j) A person found guilty of violating paragraphs (a), (b), | ||||||
20 | or (i) of this
Section shall be guilty of a petty offense and | ||||||
21 | fined no less than $50 nor more
than $500. A second or | ||||||
22 | subsequent violation of paragraphs (a), (b), or (i) of
this | ||||||
23 | Section shall be treated as a Class C misdemeanor and the | ||||||
24 | violator fined
no less than $100 nor more than $500. Any person | ||||||
25 | convicted under paragraphs
(a), (b), or (i) of this Section | ||||||
26 | shall be ordered to alter any
nonconforming windows into | ||||||
27 | compliance with this Section.

29 | Section 99. Effective date. This Act takes effect upon | ||||||
30 | becoming law.
