| AN ACT concerning State government.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|
4 |
| Section 5. The Department of Public Health Act is amended |
5 |
| by changing Section 8.1 as follows:
|
6 |
| (20 ILCS 2305/8.1) (from Ch. 111 1/2, par. 24)
|

| Sec. 8.1. Whoever violates or refuses to obey any rule or
|
8 |
| regulation of the
the
Department of Public Health shall be |
9 |
| deemed guilty of a Class A
misdemeanor. The Director of Public |
10 |
| Health shall institute prosecutions and
proceedings for |
11 |
| violation of the rules and regulations adopted by the
|
12 |
| Department of Public Health, provided that he may designate a |
13 |
| local board
of health or local health officer to institute |
14 |
| prosecutions or proceedings
for violation of those rules and |
15 |
| regulations adopted by the Department.
Each State's Attorney |
16 |
| shall prosecute all persons in his county violating
or refusing |
17 |
| to obey the rules and regulations of the Department of Public
|
18 |
| Health. All fines or judgments collected or received shall be |
19 |
| paid to the
County Treasurer of the county in which prosecution |
20 |
| is conducted. |
