| AN ACT concerning safety.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|
4 |
| Section 5. The Environmental Protection Act is amended by |
5 |
| changing Section 13.2 as follows:
|
6 |

| Sec. 13.2. At the
the request of the owner or user of a
|
8 |
| private well, the Agency shall provide for annual testing of |
9 |
| water from
private wells located within 1/2 mile of any active |
10 |
| or inactive sanitary
landfill or hazardous waste disposal |
11 |
| facility
at no charge to the owner of the well. |
12 |
| Before obtaining a sample for testing, the Agency shall, |
13 |
| not less than
5 business days prior to obtaining the sample, |
14 |
| notify the owner or operator
of the sanitary landfill or |
15 |
| hazardous waste disposal facility of the
opportunity to obtain |
16 |
| a split sample and specify the sampling procedure,
testing |
17 |
| procedure and analytical parameters to be evaluated.
|
18 |
| Sample collection shall be conducted in cooperation with |
19 |
| the Illinois
Department of Public Health and the recognized |
20 |
| local health department,
where one exists, in whose |
21 |
| jurisdiction the well is located. The Illinois
Department of |
22 |
| Public Health and the local health department shall be
provided |
23 |
| with a written report of results upon completion of sample |
24 |
| testing.
