1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Human Services Act is amended
5 by adding Section 10-8 as follows:
 
6     (20 ILCS 1305/10-8 new)
7     Sec. 10-8. The Diabetes Research Checkoff Fund; grants. The
8 Diabetes Research Checkoff Fund is created as a special fund in
9 the State treasury. From appropriations to the Department from
10 the Fund, the Department must make grants to public or private
11 entities in Illinois for the purpose of funding research
12 concerning the disease of diabetes. At least 50% of the grants
13 made from the Fund by the Department must be made to entities
14 that conduct research for juvenile diabetes. For purposes of
15 this Section, the term "research" includes, without
16 limitation, expenditures to develop and advance the
17 understanding, techniques, and modalities effective in the
18 detection, prevention, screening, and treatment of diabetes
19 and may include clinical trials.
20     Moneys received for the purposes of this Section,
21 including, without limitation, income tax checkoff receipts
22 and gifts, grants, and awards from any public or private
23 entity, must be deposited into the Fund. Any interest earned on
24 moneys in the Fund must be deposited into the Fund.
 
25     Section 10. The State Finance Act is amended by adding
26 Section 5.640 as follows:

29     Section 15. The Illinois Income Tax Act is amended by

1 changing Sections 509 and 510 and by adding Section 507EE as
2 follows:
 
3     (35 ILCS 5/507EE new)
4     Sec. 507EE. Diabetes Research Checkoff Fund checkoff. For
5 taxable years ending on or after December 31, 2005, the
6 Department must print on its standard individual income tax
7 form a provision indicating that if the taxpayer wishes to
8 contribute to the Diabetes Research Checkoff Fund, as
9 authorized by this amendatory Act of the 94th General Assembly,
10 he or she may do so by stating the amount of the contribution
11 (not less than $1) on the return and that the contribution will
12 reduce the taxpayer's refund or increase the amount of payment
13 to accompany the return. Failure to remit any amount of
14 increased payment shall reduce the contribution accordingly.
15 This Section does not apply to any amended return.

17     Sec. 509. Tax checkoff explanations. All individual income
18 tax return forms shall contain appropriate explanations and
19 spaces to enable the taxpayers to designate contributions to
20 the following funds: the Child Abuse Prevention Fund, the
21 Illinois Wildlife Preservation Fund (as required by the
22 Illinois Non-Game Wildlife Protection Act), the Alzheimer's
23 Disease Research Fund (as required by the Alzheimer's Disease
24 Research Act), the Assistance to the Homeless Fund (as required
25 by this Act), the Penny Severns Breast and Cervical Cancer
26 Research Fund, the National World War II Memorial Fund, the
27 Prostate Cancer Research Fund, the Lou Gehrig's Disease (ALS)
28 Research Fund, the Multiple Sclerosis Assistance Fund, the
29 Leukemia Treatment and Education Fund, the World War II
30 Illinois Veterans Memorial Fund, the Korean War Veterans
31 National Museum and Library Fund, the Illinois Military Family
32 Relief Fund, the Illinois Veterans' Homes Fund, the Diabetes
33 Research Checkoff Fund, and the Asthma and Lung Research Fund.
34     Each form shall contain a statement that the contributions

1 will reduce the taxpayer's refund or increase the amount of
2 payment to accompany the return. Failure to remit any amount of
3 increased payment shall reduce the contribution accordingly.
4     If, on October 1 of any year, the total contributions to
5 any one of the funds made under this Section do not equal
6 $100,000 or more, the explanations and spaces for designating
7 contributions to the fund shall be removed from the individual
8 income tax return forms for the following and all subsequent
9 years and all subsequent contributions to the fund shall be
10 refunded to the taxpayer.

16     Sec. 510. Determination of amounts contributed. The
17 Department shall determine the total amount contributed to each
18 of the following: the Child Abuse Prevention Fund, the Illinois
19 Wildlife Preservation Fund, the Assistance to the Homeless
20 Fund, the Alzheimer's Disease Research Fund, the Penny Severns
21 Breast and Cervical Cancer Research Fund, the National World
22 War II Memorial Fund, the Prostate Cancer Research Fund, the
23 Illinois Military Family Relief Fund, the Lou Gehrig's Disease
24 (ALS) Research Fund, the Multiple Sclerosis Assistance Fund,
25 the Leukemia Treatment and Education Fund, the World War II
26 Illinois Veterans Memorial Fund, the Korean War Veterans
27 National Museum and Library Fund, the Illinois Veterans' Homes
28 Fund, the Diabetes Research Checkoff Fund, and the Asthma and
29 Lung Research Fund; and shall notify the State Comptroller and
30 the State Treasurer of the amounts to be transferred from the
31 General Revenue Fund to each fund, and upon receipt of such
32 notification the State Treasurer and Comptroller shall
33 transfer the amounts.

3     Section 99. Effective date. This Act takes effect upon
4 becoming law.
