Amends the State Guard Act. Provides for the Department of Military Affairs to issue an honorary retirement rank to a National Guard member who retires with at least 10 years of service in the Illinois National Guard and who has at least 20 qualifying years of total military service, including time served in the Illinois National Guard. The honorary retirement rank issued to a member shall be the next higher rank than the federally recognized rank that the member held at retirement. Provides that honorary retirement ranks may not be higher than ranks of Major General (officers), Sergeant Major or Chief Master Sergeant (enlisted Army or Air Force), or Chief Warrant Officer Four (warrant officers).

| AN ACT concerning State government.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The State Guard Act is amended by adding Section |
5 |
| 13.1 as follows: |

| (20 ILCS 1815/13.1 new) |

| Sec. 13.1. Retirement of members; honorary retirement |
8 |
| rank.
|

| (a) A member of the Illinois National Guard who served in |
10 |
| the Guard for a period of at least 10 years (including any |
11 |
| combination of service in a commissioned, enlisted, or warrant |
12 |
| status) and who is retiring from the Guard with at least 20 |
13 |
| qualifying years of total military service (including active |
14 |
| duty or service in the Reserve Components of the United States |
15 |
| Army, Marine Corps, Navy, Air Force, or Coast Guard), may be |
16 |
| retired from the Guard with an honorary retirement rank that is |
17 |
| the next higher rank than the federally recognized rank that |
18 |
| the member held at the time of retirement, but in no case shall |
19 |
| the honorary rank be higher than the grade of Major General |
20 |
| (officers), Sergeant Major or Chief Master Sergeant (enlisted |
21 |
| Army or Air Force, respectively) or Chief Warrant Officer Four |
22 |
| (warrant officers). |

| (b) A certificate of retirement at the honorary retirement |
24 |
| rank shall be issued to a member upon the member's request at |
25 |
| the time of retirement. The certificate shall be issued by the |
26 |
| Department of Military Affairs, and may be revoked by the |
27 |
| Adjutant General if the member misuses the honorary rank. A |
28 |
| certificate may be issued to a retiree who meets the criteria |
29 |
| in subsection (a), but who retired prior to the effective date |
30 |
| of this amendatory Act of the 94th General Assembly, if the |
31 |
| member submits a written request that is approved by the |
32 |
| Adjutant General or his or her designee.
