| AN ACT concerning criminal law.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Abortion Law of 1975 is amended by |
5 |
| changing Section 1 as follows:
|

| Sec. 1. It is the
the intention of the General Assembly of |
8 |
| the State of
Illinois to reasonably regulate abortion in |
9 |
| conformance with the
decisions of the United States Supreme |
10 |
| Court of January 22, 1973.
Without in any way restricting the |
11 |
| right of privacy of a woman or the
right of a woman to an |
12 |
| abortion under those decisions, the General
Assembly of the |
13 |
| State of Illinois do solemnly declare and find in
reaffirmation |
14 |
| of the longstanding policy of this State, that the unborn
child |
15 |
| is a human being from the time of conception and is, therefore, |
16 |
| a
legal person for purposes of the unborn child's right to life |
17 |
| and is
entitled to the right to life from conception under the |
18 |
| laws and
Constitution of this State. Further, the General |
19 |
| Assembly finds and
declares that longstanding policy of this |
20 |
| State to protect the right to
life of the unborn child from |
21 |
| conception by prohibiting abortion unless
necessary to |
22 |
| preserve the life of the mother is impermissible only
because |
23 |
| of the decisions of the United States Supreme Court and that,
|
24 |
| therefore, if those decisions of the United States Supreme |
25 |
| Court are
ever reversed or modified or the United States |
26 |
| Constitution is amended
to allow protection of the unborn then |
27 |
| the former policy of this State
to prohibit abortions unless |
28 |
| necessary for the preservation of the
mother's life shall be |
29 |
| reinstated. |

| It is the further intention of the General Assembly to |
31 |
| assure and protect
the woman's health and the integrity of the |
32 |
| woman's decision whether or
not to continue to bear a child, to |
