SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/2-3.137 new

    Amends the School Code. Requires the State Board of Education to establish a State goal that all school districts have a wellness policy that is consistent with recommendations of the Centers for Disease Control and Prevention. Requires the Department of Public Health and the State Board to form an interagency working group to publish model wellness policies and sample programs. Requires the State Board to establish a pilot project to implement model wellness policies. Creates the School Wellness Policy Taskforce to identify barriers to implementing wellness policies, recommend how to reduce those barriers, recommend statewide school nutrition standards, and evaluate the effectiveness of wellness policies. Effective immediately.

1     AN ACT concerning schools.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by adding Section
5 2-3.137 as follows:
 
6     (105 ILCS 5/2-3.137 new)
7     Sec. 2-3.137. School wellness policies; taskforce.
8     (a) The State Board of Education shall establish a State
9 goal that all school districts have a wellness policy that is
10 consistent with recommendations of the Centers for Disease
11 Control and Prevention (CDC), which recommendations include
12 the following:
13         (1) nutrition guidelines for all foods sold on school
14     campus during the school day;
15         (2) setting school goals for nutrition education and
16     physical activity;
17         (3) establishing community participation in creating
18     local wellness policies; and
19         (4) creating a plan for measuring implementation of
20     these wellness policies.
21     The Department of Public Health and State Board of
22 Education shall form an interagency working group to publish
23 model wellness policies and sample programs. Sample programs
24 shall be based on CDC recommendations for nutrition and
25 physical activity. The State Board of Education shall
26 distribute the model wellness policies to all school districts
27 before June 1, 2006. Subject to appropriation, the State Board
28 of Education shall establish a $500,000 pilot project to
29 implement model wellness policies.
30     (b) There is created the School Wellness Policy Taskforce,
31 consisting of one member representing each of the following
32 entities: the State Board of Education, the Department of

1 Public Health, the Department of Human Services, the Illinois
2 School Food Service Association, the Illinois School Health
3 Association, the Illinois Association of School Nurses, the
4 Illinois Dietetic Association, the Illinois Association of
5 School Administrators, the Illinois Association of School
6 Boards, the Illinois Association of Regional Superintendents
7 of Schools, the Illinois PTA, the American Heart Association,
8 the Illinois State Dental Society, the American Cancer Society,
9 the Healthy Schools Campaign, the Consortium to Lower Obesity
10 in Chicago Children, and the Illinois Chapter of the American
11 Academy of Pediatrics; and one at-large member with a doctorate
12 in nutrition. Each member of the taskforce shall be appointed
13 by the head of the entity that the member represents, except
14 that the at-large member shall be appointed by the State Board
15 of Education.
16     Members of the taskforce shall serve without compensation.
17 The taskforce shall meet at the call of the State Board of
18 Education. The taskforce shall report its identification of
19 barriers to implementing school wellness policies and its
20 recommendations to reduce those barriers to the General
21 Assembly and the Governor on or before January 1, 2006. The
22 taskforce shall report its recommendations on statewide school
23 nutrition standards to the General Assembly and the Governor on
24 or before January 1, 2007. The taskforce shall report its
25 evaluation of the effectiveness of school wellness policies to
26 the General Assembly and the Governor on or before January 1,
27 2008. Reports shall be made to the General Assembly by filing
28 copies of each report as provided in Section 3.1 of the General
29 Assembly Organization Act. Upon the filing of the last report,
30 the taskforce is dissolved.
31     (c) The State Board of Education may adopt any rules
32 necessary to implement this Section.
 
33     Section 99. Effective date. This Act takes effect upon
34 becoming law.
