| AMENDMENT NO. ______. Amend House Bill 704 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Construction Contract Indemnification for |

| Negligence Act is amended by changing Section 1 as follows:

| (740 ILCS 35/1) (from Ch. 29, par. 61)

| Sec. 1. With respect to
to contracts or agreements, either |
| 8 |
| public or private, for
the construction, alteration, repair or |
| 9 |
| maintenance of a building,
structure, highway bridge, viaducts |
| 10 |
| or other work dealing with
construction, or for any moving, |
| 11 |
| demolition or excavation connected
therewith, every covenant, |
| 12 |
| promise or agreement to indemnify or hold
harmless another |
| 13 |
| person from that person's own negligence is void as
against |
| 14 |
| public policy and wholly unenforceable.
