AMENDMENT TO HOUSE BILL 325

2     AMENDMENT NO. ______. Amend House Bill 325, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:

"ARTICLE 1.

 
6     Section 1-5. The Board of Trustees of The University of
7 Illinois must convey to Gene Michael Vanderport, of Vermilion
8 County, Illinois, in exchange for fair market value, based on
9 the average of 3 certified appraisals, and mutually agreed upon
10 perpetual access rights for educational and research purposes,
11 certain real property located in Vermilion County, Illinois and
12 described as follows:
13     A tract of land in the Southwest Fractional Quarter of
14     Section 1, Township 18 North, Range 11 West of the 2nd
15     Principal Meridian, bounded and described as follows:
16     Beginning at the Northwest corner of the Southwest
17     Fractional Quarter of Section 1, Township 18 North, Range
18     11 West of the 2nd Principal Meridian; thence down the
19     Vermilion River following the meanders thereof 58 poles to
20     a stone; thence in a Northeasterly direction or course to a
21     point so as to strike the North line of said Southwest
22     Fractional Quarter of said Section 1, 17 poles West of the
23     Northeast corner of said Southwest Fractional Quarter of
24     said Section 1; thence West to the place of beginning,

1     EXCEPT 4.5 acres in a triangular shape off the Northeast
2     corner of said described tract, situated in Vermilion
3     County, Illinois.
 
4     Section 1-10.
5     (a) The State Property Control Act does not apply to the
6 transfer of the real property described in Section 1-5 of this
7 Act.
8     (b) The provisions of this Act are judicially enforceable.

ARTICLE 5.

 
10     Section 5-5. Upon the payment of the sum of $7,033,333,
11 based on the average of 3 certified appraisals, to the
12 University of Illinois, the Board of Trustees of the University
13 of Illinois is authorized to convey by quitclaim deed all
14 rights, title, and interest in and to the following described
15 land in Cook County, Illinois, to the Chicago Park District:
 
16     PARCEL 1:
 
17     LOTS 1 TO 8 IN SPRY'S SUBDIVISION OF LOTS 11, 12 AND 13 OF
18 BLOCK 8 OF DUNCAN'S ADDITION TO CHICAGO, A SUBDIVISION OF THE
19 EAST 1/2 OF THE NORTHEAST 1/4 OF SECTION 17, TOWNSHIP 39 NORTH,
20 RANGE 14 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY,
21 ILLINOIS.
 
22     PARCEL 2:
 
23     LOTS 4 TO 10 IN BLOCK 8 IN DUNCAN'S ADDITION TO CHICAGO, A
24 SUB OF THE EAST 1/2 OF THE NORTHEAST 1/4 OF SECTION 17,
25 TOWNSHIP 39 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPAL
26 MERIDIAN, IN COOK COUNTY, ILLINOIS.

1     Section 5-10. The Board of Trustees of the University of
2 Illinois shall obtain a certified copy of the portions of this
3 Act containing the title, enacting clause, this Article 5, and
4 Article 99 within 60 days after this Act's effective date and,
5 upon receipt of the payment required by Section 5-5 of this
6 Act, shall record the certified document in the Recorder's
7 Office of Cook County, Illinois.

ARTICLE 90.

 
9     Section 90-5. The State Property Control Act is amended by
10 changing Section 1.02 as follows:
 
11     (30 ILCS 605/1.02)  (from Ch. 127, par. 133b3)
12     Sec. 1.02. "Property" means State owned property and
13 includes all real estate, with the exception of rights of way
14 for State water resource and highway improvements, traffic
15 signs and traffic signals, and with the exception of common
16 school property; and all tangible personal property with the
17 exception of properties specifically exempted by the
18 administrator, provided that any property originally
19 classified as real property which has been detached from its
20 structure shall be classified as personal property.
21     "Property" does not include property owned by the Illinois
22 Medical District Commission and leased or occupied by others
23 for purposes permitted under the Illinois Medical District Act.
24 "Property" also does not include property owned and held by the
25 Illinois Medical District Commission for redevelopment.
26     "Property" does not include property described under
27 Section 5 of Public Act 92-371 with respect to depositing the
28 net proceeds from the sale or exchange of the property as
29 provided in Section 10 of that Act.
30     "Property" does not include that property described under
31 Section 1-5 of this amendatory Act of the 94th General
