Amends the Chicago Teacher Article of the Illinois Pension Code.
Directs the Fund to conduct a divided medicare coverage referendum, open
to teachers hired by an employer prior to March 31, 1986 and continuously employed by that employer through the effective date of this amendatory Act of the 94th General Assembly.
Allows eligible teachers to irrevocably elect to participate in the federal
medicare program. Amends the State Mandates Act to require implementation
without reimbursement. Effective immediately.

| AN ACT concerning public employee benefits.

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Pension Code is amended by adding |
5 |
| Section 17-142.2 as follows:
|

| (40 ILCS 5/17-142.2 new)
|

| Sec. 17-142.2. Medicare coverage. To provide for an |
8 |
| election of
medicare coverage.
|
9 |
| (a) The Fund shall conduct a divided medicare coverage |
10 |
| referendum, open
to any teacher who was hired by an employer |
11 |
| prior to March 31, 1986 and has been continuously employed by |
12 |
| the same employer through the effective date of this amendatory |
13 |
| Act of the 94th General Assembly.
The referendum shall be |
14 |
| conducted in accordance with the applicable provisions
of |
15 |
| federal law and Article 21 of this Code.
|

| (b) A teacher's election to participate in the federal |
17 |
| medicare program is
irrevocable.
|
18 |
| (c) Employers shall pay the necessary employer |
19 |
| contributions and make the
necessary deductions from salary for |
20 |
| teachers who elect to participate in the
federal medicare |
21 |
| program under this Section, as required by the Fund, Article
21 |
22 |
| of this Code, and federal law.
|

| Section 90. The State Mandates Act is amended by adding |
24 |
| Section 8.29 as
follows:
|

| (30 ILCS 805/8.29 new)
|

| Sec. 8.29. Exempt mandate. Notwithstanding Sections 6 and 8 |
27 |
| of this
Act, no reimbursement by the State is required for the |
28 |
| implementation of
any mandate created by this amendatory Act of |
29 |
| the 94th General Assembly.

| Section 99. Effective date. This Act takes effect upon |
