| AMENDMENT NO. ______. Amend House Bill 112, AS AMENDED, by |

| replacing everything after the enacting clause with the |
4 |
| following:

| "Section 5. The Illinois Vehicle Code is amended by adding |
6 |
| Section 12-705.1 as follows: |

| (625 ILCS 5/12-705.1 new)
|

| Sec. 12-705.1. Required use of biodiesel by certain |
9 |
| vehicles. |

| (a) Beginning January 1, 2006, any diesel powered vehicle |
11 |
| owned or operated by this State, any county or unit of local |
12 |
| government, any school district, any community college or |
13 |
| public college or university, or any mass transit agency must, |
14 |
| when refueling at a bulk central fueling facility, use a |
15 |
| biodiesel blend that contains 2 percent biodiesel, as those |
16 |
| terms are defined in the Illinois Renewable Fuels Development |
17 |
| Program Act, where available, unless the engine is designed or |
18 |
| retrofitted to operate on a higher percentage of biodiesel. |
19 |
| (b) Nothing in this Section prohibits any unit of |
20 |
| government from using a biodiesel blend containing more than 2 |
21 |
| percent biodiesel. |

| (c) As used in this Section, a "bulk central fueling |
23 |
| facility" means a non-commercial fueling facility whose |
24 |
| primary purpose is the fueling of vehicles owned or operated by |
