Amends the Counties Code. Provides that a county board may license or regulate any business (i) that is operating as a public accommodation or an adult entertainment facility; (ii) that is located in an unincorporated area of
the county; (iii) that permits the consumption of alcoholic liquor on the
premises; and (iv) that is not licensed under the Liquor Control Act of 1934. Amends the Illinois Municipal Code. Provides that the corporate
authorities of each municipality may license or regulate
any business (i) that is operating as a public accommodation or an adult entertainment facility; (ii) that permits the consumption of alcoholic liquor on the
premises; and (iii) that is not licensed under the Liquor Control Act of 1934. Effective immediately.

| Be it enacted by the People of the State of Illinois, |

| represented in the General Assembly:
|

| Section 5. The Counties Code is amended by adding Section |
5 |
| 5-1126 as follows:
|

| (55 ILCS 5/5-1126 new)
|

| Sec. 5-1126. Regulation and licensure; public |
8 |
| accommodation; adult entertainment facility.
|

| (a) A county board may license or regulate any business (i) |
10 |
| that is operating
as a public accommodation or an adult |
11 |
| entertainment facility; (ii) that is located in an |
12 |
| unincorporated area of the
county; (iii) that permits the |
13 |
| consumption of alcoholic
liquor on the business premises; and |
14 |
| (iv) that is not licensed under the Liquor
Control Act of 1934. |

| (b) For purposes of this Section: |
16 |
| "Public accommodation"
means a refreshment, |
17 |
| entertainment, or recreation facility of any kind, whether
|
18 |
| licensed or not, whose goods, services, facilities, |
19 |
| privileges, or advantages
are extended, offered, sold, or |
20 |
| otherwise made available to the public. |
21 |
| "Adult entertainment facility" means that term as it is |
22 |
| defined in Section 5-1097.5.

| Section 10. The Illinois Municipal Code is amended by |
24 |
| adding Section
11-42-10.1 as follows:
