SYNOPSIS AS INTRODUCED:
 
235 ILCS 5/10-4   from Ch. 43, par. 186

    Amends the Liquor Control Act of 1934. Provides that if a licensee appeals a decision of the State Commission or the local commissioner to revoke his or her license, (1) in the case of a first appeal, the licensee may not sell alcoholic liquor while the appeal is pending unless the licensee posts a bond in an amount set by the State commission or the local commissioner (whichever has jurisdiction) and (2) in the case of a second or subsequent appeal, the licensee may not sell alcoholic liquor while the appeal is pending. Effective immediately.

1     AN ACT concerning alcoholic liquor.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Liquor Control Act of 1934 is amended by
5 changing Section 10-4 as follows:
 
6     (235 ILCS 5/10-4)  (from Ch. 43, par. 186)
7     Sec. 10-4. Whenever any licensee shall be convicted of any
8 violation of this Act, the licenses of said licensee may, in
9 the discretion of the State commission or of the local
10 commissioner, (whichever has jurisdiction) be revoked and
11 forfeited and all fees paid thereon shall be forfeited, and the
12 bond given by said licensee to secure such licensee's faithful
13 compliance with the terms of this Act shall be forfeited, and
14 it shall thereafter be unlawful and shall constitute a further
15 violation of this Act for said licensee to continue to operate
16 under said license.
17     If a licensee appeals the decision of the State Commission
18 or the local commissioner to revoke his or her license, (1) in
19 the case of a first appeal, the licensee may not sell alcoholic
20 liquor while the appeal is pending unless the licensee posts a
21 bond in an amount set by the State commission or the local
22 commissioner (whichever has jurisdiction) and (2) in the case
23 of a second or subsequent appeal, the licensee may not sell
24 alcoholic liquor while the appeal is pending.

26     Section 99. Effective date. This Act takes effect upon
27 becoming law.
