Synopsis As Introduced
Amends the School Code. With respect to a pupil whom a school board has exempted from the requirement that the pupil engage daily in physical education because he or she must utilize the time set aside for physical education to receive special education support and services, provides that the pupil's individualized education program team makes the determination that the pupil must utilize the time set aside for physical education to receive special education support and services. Effective immediately.

Senate Committee Amendment No. 1
Provides that a special education pupil requiring adapted physical education must receive that service in accordance with the individualized education program developed for the pupil.

House Amendment No. 2
Deletes everything after the enacting clause. Reinserts the contents of the bill as engrossed, with the following change. Provides that a pupil in any of grades 3 through 12 who is eligible for special education may be excused from engaging in a physical education course if the pupil's parent or guardian agrees that the pupil must utilize the time set aside for physical education to receive special education support and services or, if there is no agreement, the individualized education program team for the pupil determines that the pupil must utilize the time set aside for physical education to receive special education support and services (instead of allowing a school board to excuse a pupil in any of grades 9 through 12 if the pupil's individualized education program team determines that he or she must utilize the time set aside for physical education to receive special education support and services). Effective immediately.

House Amendment No. 3
Provides that the agreement by the parent or guardian or the determination by the individualized education program team that a pupil be excused from physical education to receive special education support and services must be made a part of the individualized education program.
