Synopsis As Introduced
Amends the Code of Civil Procedure. Provides that records of health care practitioners shall be made available for examination or copying to any person, entity, or organization that presents a valid authorization for the release of records. Provides that records of an attorney shall be made available for examination or copying to any person, entity, or organization that presents a valid authorization for the release of those records, subject to conditions currently in the Section.

Deletes everything after the enacting clause. Amends the Code of Civil Procedure. Changes all existing references to "physician" to "healthcare practitioner" in provisions regarding the examination of a patient's health records. Provides that records of a health care practitioner shall be made available for examination or copying to any person, entity, or organization presenting a valid authorization for the release of records. Provides that the records of an attorney shall be made available for examination or copying to any person, entity, or organization presenting a valid authorization for the release of those records, subject to specified conditions. Deletes a reference to a repealed Section.

Further amends the Code of Civil Procedure. Adds definition of "practitioner" to provision concerning the examination of health care records and deletes the definition of "practitioner" from provision concerning records of health care practitioners. Deletes from the bill the language amending the provisions concerning attorney's records.

Further amends the Code of Civil Procedure. Provides an additional exception (at present, there are 11 exceptions) to a physician or surgeon disclosing information acquired while attending a patient: when subpoenaed for a professional regulation case under one of the Acts regulating physicians, dentists, or nursing home administrators.
