Synopsis As Introduced
Amends the State Finance Act. Provides that, through fiscal year 2007, no amount may be transferred from the State Police Vehicle Fund to the General Revenue Fund. Amends the Illinois Vehicle Code, the Clerks of Courts Act, and the Unified Code of Corrections. Provides that any person who receives a disposition of court supervision for a violation of the Illinois Vehicle Code must pay an additional fee of $10, to be deposited into the State Police Vehicle Fund.

House Amendment No. 1
Increases the amount of the additional fee from $10 to $25. Provides that the fee shall be deposited into the State Police Vehicle Fund only if an officer of the Department of State Police arrested the person for the violation. Provides that, if an officer of any law enforcement agency in the State other than the Department of State Police arrested the person for the violation, the fee shall be paid to the law enforcement agency that employed the arresting officer and shall be used for the acquisition or maintenance of police vehicles.

Deletes everything after the enacting clause. Reinserts the provisions of the amended bill, with changes, deletions, and additions. Deletes language providing that the prohibition against transfers from the State Police Vehicle Fund to the General Revenue Fund extends only through Fiscal Year 2007. Provides that a $20 court supervision fee shall be collected only if the defendant appears in court and an additional $5 fee shall be collected only if the defendant appears in court and the court does not waive the fee. Provides that the $5 fee shall be deposited into the Circuit Clerk Operation and Administrative Fund created by the Clerk of the Circuit Court. Provides that each Circuit Clerk shall create a Circuit Clerk Operation and Administrative Fund to offset the cost incurred by the Circuit Court Clerk in performing the additional duties required to collect and disburse funds to entities of State and local government as provided by law. Provides that the $20 fee shall be paid to the Department of State Police or to another law enforcement agency, as provided in the amended bill.

House Amendment No. 4
Further amends the Clerks of Courts Act. Makes clarifying changes relating to the distribution of the court supervision fees collected under Section 16-104c of the Illinois Vehicle Code. Also adds an immediate effective date.
