Synopsis As Introduced
Amends the Election Code. Provides that when a qualified elector's precinct polling place is a school and the elector will be unable to enter the school to vote because the elector is a child sex offender, the elector may vote early or by absentee ballot. Requires that an election authority that designates permanent or temporary early voting polling places must designate at least one that a child sex offender may lawfully enter. Requires that an election authority provide election-day voting at its principal office for child sex offenders who cannot lawfully enter their assigned precinct polling place. Amends the Criminal Code of 1961. In the provision prohibiting a child sex offender from entering a school, removes language providing that a child sex offender has the right to be present in a school building to vote. Provides that it is a Class 4 felony for a child sex offender to knowingly be present within 100 feet of a site posted as a pick-up or discharge stop for a conveyance owned, leased, or contracted by a school to transport students to or from school or a school related activity when one or more persons under the age of 18 are present at the site. Effective immediately.

Provides that a person convicted of a sex offense as defined in the Sex Offender Registration Act is ineligible to vote at any election for the duration of the sex offender's natural life. Amends the Criminal Code of 1961. Eliminates a provision that permits a child sex offender to be present in a school building that is used as a polling place for the purpose of voting. Effective immediately.

Provides that a person convicted of a sex offense as defined in the Sex Offender Registration Act that is a felony and that is committed on or after the effective date of this amendatory Act is ineligible to vote at any election for the duration of the sex offender's natural life. Amends the Criminal Code of 1961. Makes conforming changes. Amends the Unified Code of Corrections. Provides that the court shall impose as part of the sentence of a person convicted of a sex offense as defined in the Sex Offender Registration Act that is a felony and that is committed on or after the effective date of this amendatory Act that the person register as a sex offender under the Sex Offender Registration Act. Provides that the registration requirements for these felony sex offenders are a part of the sentence. Amends the Sex Offender Registration Act. Requires felony sex offenders who commit their offenses on or after the effective date of this amendatory Act to register for their natural lives. Effective immediately.

Deletes everything after the enacting clause. Reinserts the provisions of House Amendment No. 2 with the following changes: In the Election Code, provides that sex offenders who committed (i) felony sex offenses before the bill’s effective date or (ii) misdemeanor sex offenses at any time may not vote by absentee ballot or on election day in precinct polling places but may vote only by early or grace period ballots. In the Criminal Code of 1961, with respect to the prohibition against a child sex offender in a school zone, prohibits the offender from knowingly being within 100 feet of a posted pick-up and discharge site for conveyances owned, leased, or contracted by a school for the transport of students to or from school or a school activity if one or more persons under the age of 18 are present at the site. Adds severability provision. Effective immediately.
